Հանցագործության ծանր դեպքը չգրանցած ոստիկանության Վաղարշապատի բաժնի 11 ծառայողի վերաբերյալ քրեական վարույթն ուղարկվել է դատարան

ՀՀ ՆԳՆ ներքին անվտանգության և հակակոռուպցիոն վարչությունից ստացված նյութերի հիման վրա ՀՀ հակակոռուպցիոն կոմիտեում նախաձեռնված քրեական վարույթի նախաքննությամբ բացահայտվել են ոստիկանության 11 ծառայողների կողմից պաշտոնեական դիրքի չարաշահման, պաշտոնեական կեղծիք կատարելու և հիշյալ առերևույթ հանցանքներին օժանդակելու դեպքեր:

Մասնավորապես՝ նախաքննությամբ պարզվել է, որ 2024 թվականի օգոստոսի 16-ին ոստիկանության Վաղարշապատի բաժնի օպերատիվ խմբի չորս ծառայողներ և ոստիկանության պարեկային ծառայության Արմավիրի մարզի գումարտակի հինգ պարեկներ ստացված ահազանգերի հիման վրա ժամանելով Փարաքար համայնքում գործող ռեստորանային համալիր և տեղեկանալով հյուրերի մասնակցությամբ տեղի ունեցած մարմնական վնասվածքներով զուգորդված խուլիգանության դեպքի վերաբերյալ, նկատել են այդ մասին վկայող մի շարք ապացույցներ, այդ թվում՝ արնանման հետքեր, որի մասին զեկուցել են Վաղարշապատի բաժնի պետի պարտականությունները կատարող պաշտոնատար անձին: Վերջինս, սակայն, ոստիկանության ծառայողներին ապօրինի հանձնարարություն է տվել՝ ծառայողական պարտականությունները կատարելու փոխարեն վերադառնալ ոստիկանության բաժին, իսկ ահազանգի վերաբերյալ փաստաթղթաշրջանառություն իրականացրած ոստիկանության ծառայողները համապատասխան փաստաթղթերում խեղաթյուրել են դեպքի իրական հանգամանքները:

Արդյունքում՝ ոստիկանության վերը նշված աշխատակիցները չեն կատարել իրենց ծառայողական պարտականությունները՝ միջոցներ չեն ձեռնարկել ենթադրյալ հանցանք կատարողների և տուժողների վերաբերյալ տեղեկություններ պարզելու ուղղությամբ, չեն պահպանել դեպքի վայրը և ապացույցները, չեն ներկայացրել հանցանքի մասին հաղորդում, ինչի հետևանքով առերևույթ հանցագործության ծանր դեպքը և այն կատարած անձինք չեն բացահայտվել:

Ոստիկանության Վաղարշապատի բաժնի պետի պարտականությունները կատարած պաշտոնյային մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 441-րդ հոդվածի 2-րդ մասի 4-րդ կետով: Նրա նկատմամբ որպես համակցված խափանման միջոց կիրառվել է պաշտոնավարման կասեցումն ու տնային կալանքը: Ոստիկանության ևս 10 ծառայողի մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 441-րդ հոդվածի 2-րդ մասի 4-րդ կետով, 445-րդ հոդվածի 1-ին մասով, 46-441-րդ հոդվածի 2-րդ մասի 4-րդ կետով և 46-445-րդ հոդվածի 1-ին մասով: Մեղադրյալների նկատմամբ որպես համակցված խափանման միջոցներ ընտրվել են բացակայելու արգելքն ու պաշտոնավարման կասեցումը:

Քրեական վարույթով նախաքննությունն ավարտվել է, և վարույթի նյութերը մեղադրական եզրակացությամբ ուղարկվել են ՀՀ հակակոռուպցիոն դատարան:

Ծանուցում.  հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
