«Այս օրենքը թաղում է բուհական համակարգը»․ Արմեն Աշոտյան

Արմեն Աշոտյանը ֆեյսբուքյան իր էջում գրում է․

«Այսօր Ազգային ժողովում ընդունվեց «Բարձրագույն կրթության եւ գիտության մասին» նոր օրենքը:
Այն, որ Հայաստանին պետք էր ոլորտը կարգավորող նոր օրենք, վաղուց էր հայտնի: Դեռևս 2015-2016 թթ որպես ԿԳ նախարար օրենքի նոր նախագիծ ներկայացրել էի ՀՀ Կառավարություն, որի ընդունումը ձգձգվեց 5 տարի:

Սակայն նոր օրենքի անհրաժեշտության քողի ներքո այս տգետ և անբարոյական իշխանությունները ոլորտային խնդիրներից զատ իրականում կրթության և գիտության ոլորտները վերջնականապես ապականելու վճռական քայլ են արել:

Ակնհայտ է, որ սղցրած նախագիծը կոպտորեն հակասում է ՀՀ Սահմանադրությանը, որի հոդված 38-ը երաշխավորում է բուհական ինքնակառավարումը և ակադեմիական ազատությունները:

Ընդունված տարբերակում կառավարությունն իր թաթն է դրել բուհի կառավարման 2 կարևորագույն օղակների վրա՝ խորհրդի և ռեկտորի:
Խորհրդում 9 անդամներից 5-ը ներկայացվելու են լիազոր մարմնի ղեկավարի կողմից (հոդված 27, 3 մաս, 2-րդ կետ), իսկ ռեկտորի ընտրության, իսկ իրականում՝ նշանակման որոշումը նույնպես կայացնելու է լիազոր մարմնի ղեկավարը (հոդված 30, 1 մաս, 4-րդ կետ):

Նշված խայտառակությունը ոտնահարում է ոչ միայն ՀՀ Սահմանադրությունը, այլև Եվրոպական բարձրագույն կրթության տարածքի (Բոլոնիայի գործընթացի) սկզբունքները:

Ըստ միջազգային մեթադաբանության, բուհերի ինքնակառավարումը բաղկացած է 4 բաղադրիչներից՝ կառուցվածաքային ավտոնոմիա, ակադեմիական ավտոնոմիա, ֆինանսական ավտոնոմիա և կադրային ավտոնոմիա:

Տարրական գիտելիքիների և բարոյականության առկայության դեպքում անհերքելի է այն արձանագորւմը, որ երբ բուհի կառավարման երկու կարևոր օղակներ՝ խորհուրդն ու ռեկտորը, լինելու են լիազոր մարմնի, այն է՝ նախարարաի դրածոները, խոսել որևէ ինքակառավարման կամ ակադեմիական ազատությունների դրսևորման մասին զավեշտալի է:

Օրենքում կան բազմաթիվ այլ վիճելի և խնդրահարույց դրույթներ, այդ թվում՝ գիտությանը վերաբերող:

Այս օրենքը թաղում է բուհական համակարգը: Նախարարությունը բուհերի կոկորդից է բռնելու:

Դա կանխելու համար դեռ ֆորմալ ուղիներ կան: Արմեն Սարգսյանը կամ ԱԺ ոչ իշխանական խմբակցությունները դեռ շանս ունեն դիմելու ՍԴ»:
