ՀԷՑ-ի անօրինական բռնագրավումը վանում է ներդրողներին

Ոչ մի միջազգային ներդրող չի համաձայնի կառավարել ՀԷՑ-ի նման խոշոր ակտիվ, քանի որ ընկերությունը նախկինում բռնագրավվել է իր օրինական սեփականատիրոջից։ Ոչ մի միջազգային կազմակերպություն չի կարող վստահ լինել, որ նույնը չի կրկնվի նաև իրենց դեպքում։ Այս իրավիճակում իշխանությունները կանգնած են լուրջ խնդիրների առաջ, սակայն շարունակում են գործել նախընտրական տրամաբանությամբ՝ փորձելով «պատժել» ընկերության նախկին սեփականատեր Սամվել Կարապետյանին։

Ամերիկացի հայտնի փաստաբան Ռոբերտ Ամստերդամը իր հրապարակմամբ ևս մեկ անգամ ընդգծել է՝ Սամվել Կարապետյանի գործը ոչ թե արդարադատության, այլ քաղաքական հաշվեհարդարի դրսևորում է։

«Չեմ զլանա նորից ընդգծել, թե ինչու է Սամվել Կարապետյանի գործը քաղաքական։ Իմ վերջին հայտարարությունում ես արդեն նշել եմ մի շարք հանգամանքներ, որոնք հստակ վկայում են գործի քաղաքական բնույթի մասին։ Այնուամենայնիվ, հստակեցնենք հիմնական ցուցիչները։

Քաղաքական կապեր դատախազության հետ․ գործը նախաձեռնել է գլխավոր դատախազը, որի սերտ կապերը վարչապետի հետ կասկածի տակ են դնում դատավարության անկախությունը։
Վարչապետի անձնական ներգրավվածությունը․ իրավական երկրներում գործադիր իշխանության ղեկավարի անմիջական միջամտությունը դատական գործընթացին անթույլատրելի է։ Սակայն հենց վարչապետն է հրապարակային հայտարարություններով փորձել ուղղորդել գործի ընթացքը։
Անօրինական հիմքեր կալանքի համար․ Կարապետյանին վերագրված խոսքերն օգտագործվել են որպես կալանքի պատճառ, մինչդեռ միջազգային իրավական պրակտիկան նման նախադեպերը բացարձակապես չի ճանաչում։

Այս բոլոր ցուցիչները միասին վկայում են, որ գործը ոչ թե արդարադատության, այլ՝ քաղաքական հաշվեհարդարի մասին է»,- գրել է Ամստերդամը։

ՀԷՑ-ի դեպքը կարող է դառնալ վտանգավոր նախադեպ։
Ստեղծված իրավիճակում օտարերկրյա ներդրողները պարզապես չեն գա Հայաստան։ Ներդրումային միջավայրը կկորցնի վստահությունը, իսկ տնտեսության բազային կրճատումը կդառնա անխուսափելի։ Սամվել Կարապետյանի նման խոշոր գործարարի և բարերարի նկատմամբ իրականացվող քաղաքական հետապնդումները փակում են բոլոր դռները դեպի առողջ, ներդրումային Հայաստան։

Իշխանությունը, փորձելով լռեցնել բոլորին՝ ձերբակալությունների միջոցով, վերջնականապես կործանում է պետության իրավական համակարգը։ Իսկ օրերից մի օր հենց այդ անօրինականությունների համար կարող է ինքը հայտնվել այն ճաղերի ետևում, որոնք այսօր օգտագործում է իր ընդդիմախոսներին լռեցնելու համար։
