ՀԷՑ-ի անօրինական բռնագրավման վտանգավոր նախադեպը

«Հայաստանի էլեկտրական ցանցեր» (ՀԷՑ) ընկերության շուրջ ստեղծված իրավիճակը վաղուց դուրս է եկել սովորական կառավարման հարցերի շրջանակից և դարձել է պետական իրավական մշակույթի լուրջ փորձություն։ Նախկին գլխավոր տնօրենի տեղակալ Դավիթ Ղազինյանը հրապարակային բանավեճի առաջարկով դիմեց ՀԷՑ-ի ներկայիս ժամանակավոր ղեկավարությանը՝ ընդգծելով, որ հասարակությունը պետք է լսի բոլոր կողմերին բաց և թափանցիկ ձևով։ Այս քայլը ևս մեկ անգամ մատնանշեց այն փաստը, որ ոլորտը պահանջում է հրապարակային պարզաբանումներ և հաշվետվողականություն։

Հիմնական խնդիրը, սակայն, մնում է անփոփոխ՝ ՀԷՑ-ը փաստացի բռնագրավվել է իր օրինական սեփականատիրոջից։ Սա ոչ միայն իրավական, այլև տնտեսական խիստ վտանգավոր նախադեպ է․ որևէ միջազգային ներդրող չի ցանկանա գործ ունենալ ակտիվի հետ, որի սեփականության անխախտելիությունը հարցականի տակ է դրված։ Եթե պետությունը կարող է այսպիսի կերպով զրկել սեփականատիրոջը իր ունեցվածքից, նույնը կարող է կրկնվել ցանկացած այլ ներդրողի հետ։

Կառավարության գործողությունները, թվում է, պայմանավորված են ոչ թե ոլորտի կայունացման և էներգետիկ համակարգի արդյունավետության բարձրացման անհրաժեշտությամբ, այլ քաղաքական հաշվարկներով՝ հատկապես նախկին սեփականատեր Սամվել Կարապետյանին «պատժելու» մղումով։ Այս մոտեցումը ոչ միայն վնասում է երկրի ներդրումային միջավայրին, այլև խարխլում է իրավական համակարգի նկատմամբ վստահությունը։

ՀԷՑ-ի պատմությունը պետք է դիտել որպես ազգի տնտեսական և իրավական անվտանգության հարց։ Առանց սեփականության իրավունքների հարգման և օրենքի գերակայության հնարավոր չէ ոչ ներդրումներ ներգրավել, ոչ էլ զարգացնել էներգետիկ ոլորտը։ Հայաստանում բիզնեսի և պետության հարաբերությունները չպետք է առաջնորդվեն անձնական հաշվեհարդարի տրամաբանությամբ․ դրանք պետք է հիմնվեն իրավական կանխատեսելիության և հավասար պայմանների սկզբունքների վրա։
