Սամվել Կարապետյանի պաշտպանական կողմը քրեական հանցագործության տարրեր է տեսնում ՀԾԿՀ նախագահի գործողություններում

Սամվել Կարապետյանի փաստաբանը ՀԾԿՀ նախագահ Մեսրոպ Մեսրոպյանի գործողություններում տեսնում է քրեական հանցագործության տարրեր:

«Տաշիր» ընկերությունների խմբի ղեկավար և ՀԷՑ-ի սեփականատեր Սամվել Կարապետյանի փաստաբանը Հանրային ծառայությունները կարգավորող հանձնաժողովի (ՀԾԿՀ) նախագահ Մեսրոպ Մեսրոպյանի գործողություններում տեսնում է քրեական հանցագործության տարրեր։

«Մասնավորապես, խոսքը Հայաստանի քրեական օրենսգրքի երկու կետերի մասին է՝ Հանրային ծառայությունները կարգավորող հանձնաժողովի ղեկավարի կողմից պաշտոնեական լիազորությունների չարաշահման և դատարանի որոշումը չկատարելու մասին», - ասաց «Տաշիր» ընկերությունների խմբի նախագահի փաստաբան Արմեն Ֆերոյանն այսօր ասուլիսի ժամանակ։

Նա պարզաբանեց, որ չնայած Միջազգային արբիտրաժային դատարանի որոշմանը և Հայաստանի վարչապետի՝ միջազգային իրավական հարցերով գրասենյակի ներկայացուցչի եզրակացությանը, Մեսրոպյանը չի դադարեցրել ՀԷՑ-ի ժամանակավոր կառավարիչ Ռոմանոս Պետրոսյանի գործունեությունը։

«Մենք շուտով հանցագործության մասին հաղորդում կներկայացնենք համապատասխան մարմիններին», - ասաց Ֆերոյանը։

Սամվել Կարապետյանը ձերբակալվել է ՀՀ-ում հունիսի 18-ին՝ երկու ամսով՝ իշխանությունը զավթելու հրապարակային կոչ անելու մեղադրանքով։

Սա տեղի է ունեցել այն բանից հետո, երբ Կարապետյանը, Ամենայն հայոց կաթողիկոս Գարեգին II-ի հետ հանդիպումից հետո, ասել է, որ ինքը միշտ եղել է Հայ եկեղեցու և հայ ժողովրդի կողքին, և եթե քաղաքական գործիչները չհաջողեն, ապա «մենք պատրաստ ենք մեր ձևով մասնակցել գործընթացներին»։

Այնուհետև ՀՀ վարչապետ Նիկոլ Փաշինյանը հայտարարել է ՀԷՑ-ի ազգայնացման ծրագրի պատրաստ լինելու մասին՝ պնդելով, որ գործընթացը կիրականացվի ՀՀ օրենսդրությանը համապատասխան։

«Էներգետիկայի մասին» և «Հանրային ծառայությունները կարգավորող հանձնաժողովի մասին» օրենքներում համապատասխան փոփոխություններն ընդունվել են հուլիսի 3-ին և ստորագրվել ՀՀ նախագահի կողմից հուլիսի 8-ին։

Օգոստոսի 15-ին Հակակոռուպցիոն դատարանը երկարաձգել է «Տաշիր» ընկերությունների խմբի նախագահ Սամվել Կարապետյանի կալանքը ևս երկու ամսով։

Ստոկհոլմի արբիտրաժի որոշման մասին  

2025 թվականի հուլիսի 22-ին Ստոկհոլմի առևտրային պալատի արբիտրաժային ինստիտուտի կողմից նշանակված հրատապ արբիտրաժը պարտավորեցրել է Հայաստանի Հանրապետության կառավարությանը ձեռնպահ մնալ «Հայաստանի էլեկտրական ցանցեր» փակ բաժնետիրական ընկերության նկատմամբ վերջերս ընդունված «Էներգետիկայի մասին» և «Հանրային ծառայությունները կարգավորող մարմնի մասին» ՀՀ օրենքներով սահմանված դրույթների կատարումից, ինչպես նաև «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ բռնագրավմանն ուղղված հետագա այլ քայլերից

Արբիտրաժի կողմից որոշման հրապարակումից հետո Հայաստանի Հանրապետության պետական մարմինները հանդես եկան մի շարք հայտարարություններով՝ նշելով, որ հրատապ արբիտրաժի որոշումները կարող են չկատարվել ՀՀ կառավարության կողմից, և ՀՀ տարածքում կատարման համար դրանք նախ և առաջ պետք է ճանաչվեն ՀՀ դատարանների կողմից։

Օգոստոսի 4-ին Հայաստանի կառավարությունը հայտարարեց, որ արտակարգ արբիտրաժը մերժել է «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ բաժնետերերի նոր պահանջները։
