Կարգելվի երեխայի հայրության ճանաչումը նրա կենսաբանական հայր չհանդիսացողի կողմից

Հայաստանում նախատեսում են երեխայի նկատմամբ հայրության ճանաչումը երեխայի կենսաբանական հայր չհանդիսացող անձի կողմից արգելել: 

«Արմենպրես»-ի փոխանցմամբ՝ Հայաստանի Հանրապետության ընտանեկան օրենսգրքում փոփոխություններ և լրացումներ կատարելու մաuին և կից ներկայացված օրենքների նախագծերի փաթեթն ԱԺ նիստում ներկայացրեց ՀՀ աշխատանքի և սոցիալական հարցերի նախարարի տեղակալի պաշտոնակատար Տաթևիկ Ստեփանյանը:

Ուժեղացվել են համայնքներում երեխայի պաշտպանության իրականացման հիմքերը՝ վարձատրվող մասնագիտական գործառույթի և համակարգի ներդրման միջոցով: Սահմանվել և հստակեցվել են մարզպետների աշխատակազմերում, Երևանի քաղաքապետարանում երեխայի  պաշտպանության հետ կապված լիազորություններն ու դրանց մասնագիտական բնույթը:

«Սահմանվել է բուլինգ հասկացությունը և ամրագրվել, որ պետական և տեղական ինքնակառավարման մարմիններն ու դրանց կազմակերպությունները ձեռնարկելու են արձագանքող ու կանխարգելիչ միջոցառումներ՝ երեխայի բուլինգի կանխարգելման, բացահայտման, ինչպես նաև բուլինգի վտանգի տակ գտնվող կամ ենթարկված երեխայի պաշտպանության համար»,-ասաց Ստեփանյանը: 

Նախագծով սահմանվել է, որ յուրաքանչյուր երեխա իրավունք ունի, որ իր այլընտրանքային խնամքի ձևը և դրա նշանակման կամ իրականացման մասին որոշումը պարբերաբար վերանայվեն՝ հաշվի առնելով նրա կարծիքը և լավագույն շահերը: 

«Առաջարկվում է նաև երեխայի նկատմամբ հայրության ճանաչումը երեխայի կենսաբանական հայր չհանդիսացող անձի կողմից առհասարակ արգելել»,-ասաց Ստեփանյանը: 

Հանվել է տարիքային սահմանափակումը՝ երեխայի կարծիքը հաշվի առնելու համար: «Այս պահին գործող իրավակարգավորումներով՝ հաշվի ենք առնում 10 տարեկանը լրացած երեխայի կարծիքը: Շատ անհասկանալի է, թե ինչու 9 տարեկան երեխան չի կարող իրեն վերաբերելի որոշումներում իր կարծիքն արտահայտել»,-ասաց Ստեփանյանը:

Նախագծով սահմանվում է, որ երեխան իրավունք ունի ազատ արտահայտելու իր կարծիքը, որն իր տարիքին և հասունության մակարդակին համապատասխան, հաշվի է առնվում իրեն վերաբերող հարցերում և որոշումներ կայացնելիս: Երեխայի կարծիքը լսելիս իրավասու մարմինը ներգրավում է մանկական հոգեբանի կամ սոցիալական աշխատողի: Երեխայի լսված լինելու իրավունքն ապահովելիս նրա կարծիքը չի կարող օգտագործվել կամ մեկնաբանվել ի վնաս երեխայի լավագույն շահերի:

Սահմանվել է նաև ալիմենտի վճարման անկանխիկ ձևով ընդունման կարգավորումը: 

Ըստ նախագծի՝ երեխայի մասնակցությունը որդեգրման դատավարական գործընթացին այլևս պարտադիր չէ: Իսկ ներկայիս կարգավորմամբ՝ 14 տարեկան երեխաները պարտադիր պետք է լինեն դատական դահլիճում:
