Ինչո՞ւ է Սահմանադրական դատարանը խուսափում հարցմանը պատասխանելուց. «Փաստ»

«Փաստ» օրաթերթը գրում է.

«Փաստ» թերթի տեղեկություններով, վերջերս ՀՀ պաշտպանության նախկին նախարար, գեներալ- մայոր Արշակ Կարապետյանի հիմնադրած «Համահայկական ճակատ» կուսակցությունը հարցումներ է ուղարկել պետական մի շարք գերատեսչությունների՝ կապված ՀՀ վարչապետի պաշտոնը զբաղեցնող ու ինքն իրեն կառավարության հետ նույնականացնող Նիկոլ Փաշինյանի գործողությունների իրավաչափության հետ:

Մենք դիմեցինք կուսակցության ղեկավար Արսեն Վարդանյանին՝ խնդրելով պարզաբանել, թե ի՞նչ հարցման մասին է խոսքը, կոնկրետ ու՞մ են դիմել և ի՞նչ պատասխան են ստացել: Վարդանյանը հաստատեց մեր տեղեկությունները և նշեց, որ դիմել են ՀՀ ԱԱԾ, Քննչական կոմիտե, ՄԻՊ գրասենյակ, արդարադատության նախարարություն և Սահմանադրական դատարան: Հարցը ձևակերպված է եղել այսպես. «Հայաստանի Հանրապետության վարչապետը իրավունք ունի՞ Հայաստանի Հանրապետության անունից ստորագրել խաղաղության պայմանագիր, հրաման տալ մարտական հենակետերից զորքերի հետ քաշման վերաբերյալ, տալ հանձնարարական՝ անձին կալանավորելու վերաբերյալ, վիրավորել Հայաստանի Հանրապետության քաղաքացուն։ Եթե այո, ապա խնդրում եմ նշել իրավական այն ակտը (օրենքներ, ենթաօրենսդրական կարգավորումներ), որով սահմանվում են տվյալ գործառույթների իրականացումը»:

Ճիշտ է «ցրողական», այդուամենայնիվ, մանրամասն պատասխան ստացվել է միայն արդարադատության նախարարությունից: ՄԻՊ գրասենյակից մեջբերել են մի շարք օրենքներ ու ամփոփել. «Վերոգրյալի հաշվառմամբ՝ Ձեր կողմից նշված գործառույթների վերապահում սահմանող իրավական ակտերի և դրանց վերաբերյալ պարզաբանումների ներկայացման հարցումը առաջարկվում է հասցեագրել համապատասխան իրավասու պետական մարմնին»: Քննչական կոմիտեից պատասխանել են, որ իրենց գործառույթներից դուրս հարցերին պատասխանելու իրավասություն չունեն: Գրեթե նմանատիպ պատասխան է ստացվել նաև ԱԱԾ-ից:

Ամենաուշագրավն այն է, որ ավելի քան երկու ամիս որևէ պատասխան չի ստացվել Սահմանադրական դատարանից: Արսեն Վարդանյանը մեզ հետ զրույցում տարակուսանք է հայտնում, որ բարձրագույն դատական մարմինը անտեսում է ՀՀ օրենքները և սահմանված ժամկետներում պատասխան չի ուղարկում: «Ըստ երևույթին, մյուսների նման չեն կարող խուսափողական պատասխաններ տալ և նշել, թե նման պարզաբանումն իրեն լիազորությունների մեջ չէ: Մյուս կողմից՝ այդ հարցերին պատասխանելը իշխանությունների սրտով չի լինի: Ամենայն հավանականությամբ, դրա համար էլ խուսափում են»,-ասաց Վարդանյանը:
