Կամայականության դուռ է բացվում. Թաթոյանը՝ ՀԷՑ–ին առնչվող որոշումը չկատարելու վտանգի մասին

Հայաստանի նախկին մարդու իրավունքների պաշտպան Արման Թաթոյանը անդրադարձել է «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ին (ՀԷՑ) առնչվող արբիտրաժային գործընթացին՝ բարձրաձայնելով մտահոգություններ երկրի իրավական միջավայրի և միջազգային հեղինակության վերաբերյալ։

Ըստ նրա՝ ՀՀ կառավարության արձագանքը Ստոկհոլմի առևտրային պալատի արբիտրաժային ինստիտուտի կողմից կայացված վճռին փաստում է, որ իշխանությունը պատրաստ է չկատարել այնպիսի միջազգային պայմանագրերով ստանձնած պարտավորություններ, որոնք չեն համապատասխանում վարչապետի անձնական կամ քաղաքական նախընտրություններին։ Սա, ըստ Թաթոյանի, փաստացի բացում է կամայականության դուռ՝ այնպիսի վտանգավոր նախադեպ ստեղծելով, երբ միջազգային ցանկացած դատարանի որոշում կարող է մերժվել միայն այն պատճառով, որ այն «դուր չի եկել» կառավարության ղեկավարին։

Նա ընդգծել է, որ կառավարության կողմից շրջանառվող թեզը՝ թե իբր արբիտրաժային որոշման չկատարումը տեղի է ունենում ի շահ երկրի ինքնիշխանության, իրավական առումով ոչ մի հիմք չունի և ուղղակիորեն հարվածում է Հայաստանի միջազգային հեղինակությանը։ «Այդպիսի մոտեցումը լրջորեն վնասում է ներդրումային միջավայրին, և ապացուցում է, որ Հայաստանում պետական ինստիտուտները չեն գործում։ Սա արդեն արդյունք է անձնիշխանության և կուսակցապետության համակարգի», – նշվում է գնահատականում։

Թաթոյանի խոսքով՝ իրավական լուծումը միանշանակ է՝ Հայաստանի դատարանը պարտավոր է քննարկել միայն Ստոկհոլմի արբիտրաժի որոշման ճանաչման և կատարման հարցը՝ առանց խորանալու նրա բովանդակային ասպեկտներին։ Հնարավոր մերժումը կարող է լինել բացառապես այն դեպքում, երբ տվյալ որոշումը հակասում է հանրային կարգին, սակայն այս պահին վարչապետի վարքագիծը փաստում է՝ հարցը վերածվել է անձնական-քաղաքական հակամարտության։

Հիշեցնենք, որ հուլիսի 22-ին հայտնի դարձավ՝ Սամվել Կարապետյանի ընտանիքը հաղթել է Հայաստանի կառավարության դեմ նախաձեռնած արբիտրաժային գործը։ Դրան նախորդել էր կառավարության մի շարք քայլեր՝ ուղղված ՀԷՑ-ի պետականացմանը։ Մասնավորապես, հունիսի 18-ին վարչապետ Փաշինյանը հայտարարել էր՝ հասունացել է պահը ՀԷՑ-ի ազգայնացման համար, իսկ հուլիսի 3-ին ԱԺ-ն ընդունեց համապատասխան օրենսդրական փաթեթը։ Հուլիսի 18-ին էլ Ռոմանոս Պետրոսյանը նշանակվեց ընկերության ժամանակավոր կառավարիչ՝ ՀԾԿՀ որոշմամբ։

Ընկերությունը Կարապետյանը ձեռք է բերել 2016 թվականին՝ ՀՀ նախկին իշխանությունների խնդրանքով՝ ներդնելով հարյուրավոր միլիոն դոլարներ՝ ենթակառուցվածքի արդիականացման համար։
