Հունիսին գրանցվել է ՀԴՄ կիրառման կանոնների խախտման 625 դեպք

Պետական եկամուտների կոմիտեում շարունակվում են հսկողական աշխատանքները՝ հսկիչ դրամարկղային մեքենայի կիրառման կանոնների, վարձու աշխատողի չձևակերպման և «Անկանխիկ գործառնությունների մասին» ՀՀ օրենքի պահանջների խախտման դեպքերի բացահայտումների  ուղղությամբ։ ՊԵԿ-ը հիշեցնում է, որ հսկիչ դրամարկղային մեքենայի կիրառումը պարտադիր է բնակչությանն ապրանք վաճառելիս, ծառայություն մատուցելիս կամ աշխատանք կատարելիս կանխիկ դրամով կամ վճարային քարտերի միջոցով վճարում կատարելու, այդ թվում` կանխավճար կամ մասնակի վճարում ընդունելու դեպքում: Այս մասին հայտնում են ՊԵԿ-ից:

Միաժամանակ, վարձու աշխատողին աշխատանքի ընդունելիս հարկ վճարողը պարտավոր է ապահովել աշխատանքի ընդունման մասին անհատական իրավական ակտի ընդունումը կամ գրավոր պայմանագրի կնքումը, իսկ նոր աշխատողի համար՝ սահմանված ժամկետում հարկային մարմին պետք է ներկայացնել գրանցման հայտ, կամավոր աշխատողի դեպքում՝ նրա հետ պետք է կնքել կամավոր աշխատանքի մասին պայմանագիր, իսկ հսկիչ դրամարկղային մեքենաներ կիրառելու պարտավորություն ունեցող հարկ վճարողները, «Անկանխիկ գործառնությունների մասին» ՀՀ օրենքի համաձայն, պարտադիր պետք է ապահովեն վճարային քարտերի միջոցով անկանխիկ վճարման ընդունման հնարավորություն և հետևողական լինեն օրենքի պահանջների կատարման նկատմամբ։ Իրավախախտումների կանխարգելումն ու բացահայտումը և օրենքի պահանջների նկատմամբ հսկողությունը կարևոր են յուրաքանչյուր քաղաքացու, աշխատողի, ինչպես նաև օրենքի դաշտում գործող բիզնեսի համար։

ՊԵԿ-ը տեղեկացնում է, որ 2025 թվականի հունիս ամսվա ընթացքում ավարտված հսկողական աշխատանքների արդյունքներով արձանագրվել են․

  • Հսկիչ դրամարկղային մեքենաների կիրառման կանոնների խախտման 625 դեպք և 260.6 մլն դրամի չափով տուգանք։
    Արձանագրված խախտումներից 20 դեպքով 20 հարկ վճարողի մոտ արձանագրվել է 1.0 մլն դրամ և ավելի տուգանք՝ ընդհանուր 77 մլն դրամի չափով: ՀԴՄ կիրառման կանոնների խախտում թույլ տված և 1․0 մլն դրամ և ավելի գումարով տուգանված հարկ վճարողների անվանական ցանկը՝ ըստ գործունեության ոլորտների
  • Վարձու աշխատողի չձևակերպման դեպքեր արձանագրվել են ընդհանուր առմամբ 84 հարկ վճարողի մոտ, իսկ տուգանքի չափը կազմել է 60 մլն դրամ։ Խախտում թույլ տված հարկ վճարողների ցանկը կցվում է (ՉԱ ցանկ-1)։

Երեք և ավելի վարձու աշխատողների չձևակերպման 25 դեպքով 25 հարկ վճարող տուգանվել է 42.5 մլն դրամով: Խախտում թույլ տված  հարկ վճարողների անվանական ցանկը` ըստ գործունեության ոլորտների,

  • «Անկանխիկ գործառնությունների մասին» ՀՀ օրենքի պահանջների խախտում արձանագրվել է 37 հարկ վճարողի մոտ: Արդյունքում, հարկ վճարողներին ընդհանուր առմամբ առաջադրվել է 13.2 մլն դրամի չափով տուգանք: Խախտում թույլ տված հարկ վճարողների ցանկը՝ գործունեության համապատասխան օբյեկտների լուսանկարներով, 

Միաժամանակ, Կոմիտեն տեղեկացնում է, որ խախտումներ թույլ տված հարկ վճարողների ցանկերում հաշվի չեն առնվել ստուգման ակտերի վարչական կամ դատական կարգով հնարավոր վիճարկման արդյունքները:

ՊԵԿ-ը հորդորում է հարկ վճարողներին դրսևորել հարկային կարգապահություն և հետևել օրենքի պահանջներին՝ նպաստելով կայուն և վստահելի բիզնես միջավայրի ապահովմանը։
