Երբ արդարադատությունն ու իրավապահ համակարգը վերածվում են քաղաքական գործիքի. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Մեկ շաբաթ առաջ գրել էինք, որ Նիկոլ Փաշինյանը օրերս փակ ձևաչափով հանձնարարել է ուժեղացնել ճնշումները քաղաքական մրցակիցների, այդ թվում՝ պաշտպանության նախկին նախարար Արշակ Կարապետյանի և «Տաշիր» խմբի ղեկավար Սամվել Կարապետյանի նկատմամբ։ Ըստ թերթի, իրավապահներին հանձնարարվել է Սամվել Կարապետյանի վրա «նոր, հնչեղ գործեր կարել»՝ հաշվի առնելով, որ նախորդ մեղադրանքը թույլ է և դատարանը կարող է որոշում կայացնել նրա ազատման օգտին։ Ավելին, թերթի շաբաթօրյա համարում տեղեկացրել էինք, որ Փաշինյանի մոտ մի քանի օր է՝ խորհրդակցություններ են, «գլուխ են կոտրում» Սամվել Կարապետյանի կալանքը երկարաձգելու վերաբերյալ։ Բանն այն է, որ առկա «գործով» կալանքը երկարաձգել հնարավոր չէ, ու անհրաժեշտ է արագորեն նոր գործ հորինել, որով հնարավոր կլինի ևս երկու ամսվա կալանք պահանջել դատարանից։

Եվ ահա, ցավոք, մեր հրապարակումները փաստացի հաստատվեցին. երեկ Սամվել Կարապետյանի պաշտպանական խորհուրդը հայտարարություն է տարածել, որտեղ ասվում է, որ նրան նոր՝ «փողերի լվացման» մեղադրանք է ներկայացվել՝ առանց որևէ կոնկրետ տվյալ կամ իրավական հիմնավորում ներկայացնելու։ Հայտարարության մեջ նշվում է, որ մեղադրանքը հիմնված չէ որևէ փաստի վրա. «Սամվել Կարապետյանի որևէ կոնկրետ գործողություն, որն ինչ-որ կերպ կարող է առնչվել մեղսագրվող արարքի հետ, ընդհանրապես առկա չէ. ավելին, ստացվում է, որ մեղադրանք է ներկայացվել որևէ ուղիղ կամ անուղղակի մասնակցության, ենթադրյալ միջոցները թաքցնելու կամ խեղաթյուրելու հետ կապված որևէ իրողության բացակայության պայմաններում»:

Պաշտպանական խումբը նաև հիշեցնում է, որ Սամվել Կարապետյանի՝ 2025 թվականի հունիսի 17-ի հայտարարությանը հաջորդեցին գործադիր իշխանության ղեկավարի հրապարակային ուղիղ սպառնալիքները և հաշվեհարդարի խոստումները, ժամերի ընթացքում քրեական վարույթի նախաձեռնումը, 24 ժամվա ընթացքում «իշխանությունը զավթելու կոչի» (Մայր Աթոռը պաշտպանող հայտարարության) համար Սամվել Կարապետյանի նկատմամբ ակնհայտ ապօրինի մեղադրանք ներկայացնելը և կալանավորելը։

Այս ամենը վկայում է այն մասին, որ իշխանության վախերն ու քաղաքական վերահսկողության վերահաս կորստի զգացումը վերածվում են հաշվեհարդարի համակարգված գործելաոճի։ Ընդ որում, ինչպես առիթ ունեցել ենք նշելու, օրվա իշխանություններն ու նրանց «իրավապահները» այլևս չեն էլ «չարչարվում» գոնե ձևականորեն օրենքի դրույթները պահպանելու ուղղությամբ. Նիկոլ Փաշինյանին պետք է ինչ-որ բան, ուրեմն «իրավապահները» հլու-հնազանդ կատարում են: Բայց պատմությունը սովորաբար այլ ճակատագիր է պատրաստում այն իշխանություններին, որոնք արդարադատությունը վերածում են քաղաքական գործիքի։
