Վերջապես ինչ է մեզ սպասվում և ինչպես կարող է ՀՀ պետությունը պարտվել արբիտրաժում, եթե որոշի պետականացնել կամ ազգայնացնել ՀԷՑ-ը. Հրայր Կամենդատյան

Հրայր Կամենդատյանը ֆեյսբուքյան իր էջում գրել  է․ 

Քանի որ քպ պարագլուխը որոշել է հարձակվել մասնավոր սեփականության վրա ,կարիք կա դրան եվ դրա կրքոտ քարոզիչ անտերներին բացատրել արբիտրաժի գոյության մասին։ Վերջապես ինչ է մեզ սպասվում և
ինչպես կարող է ՀՀ պետությունը պարտվել արբիտրաժում, եթե որոշի պետականացնել կամ ազգայնացնել ՀԷՑ-ը (Հայաստանի էլեկտրական ցանցերը)՝ առանց պատշաճ գործընթացի․

Ստորև ներկայացնում եմ գործընթացի հիմնական կետերը իրենց ենթակետերով։

Ա .Պայմանագրերի խախտում
ՀԷՑ-ի սեփականատերը՝ ռուսական «Տաշիր Գրուպ»-ը կամ դրա դուստր ընկերությունը, այն գնել է համաձայն գործող ներդրումային պայմանագրերի և միջազգային համաձայնությունների։

Եթե Հայաստանի պետությունը.

1. անտեսի այդ պայմանագրերը,
2. չապահովի փոխհատուցում՝ ըստ շուկայական արժեքի,
3.գործի միակողմանիորեն ու ոչ թափանցիկ,
ապա ընկերությունը կարող է դիմել միջազգային արբիտրաժային դատարան, օրինակ՝ Միջազգային ներդրումային վեճերի լուծման կենտրոն (ICSID) կամ ՄԱԿ-ի միջազգային առևտրային իրավունքի հանձնաժողով (UNCITRAL):
 
Բ. Հանրային շահի ապացույցի բացակայություն

Ազգայնացումը պետք է իրականացվի միայն այն դեպքում, երբ կա հստակ ու փաստաթղթավորված հանրային շահի վնաս։

Եթե պետությունը չի կարող ապացուցել, որ՝

1. ՀԷՑ-ը վնասում է հանրությանը,
2. ՀԷՑ-ը սպառնում է ազգային անվտանգությանը կամ էներգետիկ համակարգին,
ապա արբիտրաժը կարող է որոշել, որ ազգայնացումը կամ պետականացումը եղել է քաղաքական դրդապատճառներով և ապօրինի։

Գ. Ոչ արդար փոխհատուցում

Միջազգային իրավունքը պարտադրում է, որ նման դեպքերում տրամադրվի.

1.Արդար, արդի շուկայական արժեքով փոխհատուցում
2.Ժամանակին և ամբողջությամբ վճարված գումար։
Եթե պետությունը առաջարկի ցածր գին կամ ընդհանրապես չառաջարկի փոխհատուցում, ապա դա կհամարվի սեփականության իրավունքի կոպիտ խախտում։

Դ. Միջազգային պայմանագրերի խախտում

Հայաստանը ստորագրել է տարբեր երկկողմ ներդրումային համաձայնագրեր (BITs), որոնք երաշխավորում են՝

1. Արդար և հավասար վերաբերմունք (fair and equitable treatment),
2.Սեփականության պաշտպանության իրավունքը։
Եթե ՀԷՑ-ը միջազգային ռեզիդենտ ընկերություն է կամ կառույց, որը պաշտպանված է այս պայմանագրերով, ապա դա օգտագործվում է որպես հիմք հայցի ներկայացման համար։

Ե. Արբիտրաժի հնարավոր վճիռը

Եթե ՀՀ պարտվի, դատարանը կարող է վճռել՝

1.ՀՀ-ն պետք է վճարի բազում միլիոնավոր դոլարներ՝ որպես փոխհատուցում,
2.Հնարավոր են նաև դատական ծախսեր, տոկոսներ ու հավելավճարներ։
Պետությունն անգամ կարող է դառնալ միջազգային ֆինանսական կառույցների կողմից վարկային ճնշման կամ ակտիվների բռնագրավման թիրախ՝ եթե չկատարի վճիռը։

Եզրակացություն

Հայաստանը կարող է պարտվել, եթե․

1. Քայլերն արվեն քաղաքական, այլ ոչ իրավական հիմքով,
2. Չապացուցվի հանրային շահ,
3. Չապահովվի արդար փոխհատուցում,
4. Խախտվեն միջազգային պայմանագրերը։
