35-ամյա կնոջ սպանության գործով դատական նիստից հետո կարգադրիչ է մահացել

Երևանի ընդհանուր իրավասության քրեական դատարանի «Շենգավիթ» նստավայրում երեկ արտառոց դեպք է տեղի ունեցել՝ 35-ամյա Տաթևիկ Աբրահամյանին խեղդամահ անելու մեջ մեղադրվող Նարեկ Սարգսյանի գործով դատական նիստի ընթացքում։ Նիստերի դահլիճում գտնվող տղամարդկանցից մեկը հայտարարել է, թե իրականում ինքն է սպանել Տաթևիկ Աբրահամյանին, ապա՝ դիմել փախուստի, ինչից հետո իրավիճակը նիստերի դահլիճում գերլարվել է, անգամ դատական կարգադրիչը, որը կարգավորում էր նիստերի դահլիճը, մահացել է՝ սրտի կանգից։

Նարեկ Սարգսյանի պաշտպան Աննա Ծառուկյանը «Փաստինֆո»-ի հետ զրույցում պատմել է, որ դատական նիստի ընթացքում, երբ մեղադրանքի կողմը միջնորդում էր անթույլատրելի ապացույց ճանաչել պաշտպանության կողմի ներկայացրած որոշակի նյութեր, պաշտպանության կողմն էլ՝ միջնորդել էր հետաձգել դատական նիստը, այդ ընթացքում նիստերի դահլիճում գտնվող մեկ տղամարդ պարբերաբար կանգնել է՝ հայտարարելով, որ ասելիք ունի։

«Դատավորը թույլ չէր տալիս, ինչը բնական է, դահլիճից ամեն մեկը չի կարող կանգնել և հայտարարություն անել։ Դատարանը հորդորեց հանգիստ նստել տեղը, հակառակ դեպքում՝ սանկցիա կկիրառվի։ Նա շարունակեց պնդել, որ կարևոր ասելիք ունի՝ գործի վերաբերյալ, դատարանն էլ՝ նախազգուշական սանկցիա կիրառեց, սակայն տղամարդը շարունակեց պնդել, որ չի հեռանալու՝ մինչև գործի վերաբերյալ կարևոր տեղեկություն չտա։ Այդ պահին դատավորը վեր կացավ, ընդմիջում հայտարարեց, այդ տղան էլ այլայլված էր, երբ դատավորը գրեթե դուրս էր եկել, այդ տղան բղավեց, որ սպանությունն ինքն է կատարել»,- ասել է Ծառուկյանը՝ պատմելով, որ դրանից հետո իրավիճակը դատարանում գերլարվել է, Նարեկ Սարգսյանն անմիջապես բուռն արձագանքել է, աֆեկտի մեջ է ընկել․ «Երեք տարի կալանքի տակ է, մեղադրվում է սպանության մեջ, պնդում, որ անմեղ է, բայց այս ողջ ընթացքում իրեն կոռեկտ է պահել»։ Դատարանում խառնաշփոթ է եղել, սեղան է կոտրվել, այդ տղան փախել է՝ դուրս գալով դատավորի համար նախատեսված դռնով․ «Դուռը փակել են, որ Նարեկ Սարգսյանի ձեռքից այդ տղային կարողանան փրկել։ Իրավիճակն աննկարագրելի էր, այնտեղ պետք է լինեիք․․․ դրանից հետո այդ տղան ուր է գնացել, ինչպես են բաց թողել, ով է բաց թողել՝ նման հայտարարությունից հետո։ Ձերբակալեին, պարզեինք՝ ինչ է եղել, հաղորդում ներկայացնեին։ Իջել ենք ներքև՝ սպասելու, քանի որ ընդմիջում էր հայտարարված։ Կարգադրիչներից մեկը, որն այդ պահին դահլիճի կարգուկանոնն էր սպասարկում, իջել է ներքև և մահացել։ Նախնական տվյալներով՝ սրտի կանգ է ունեցել, նաև ասել են, որ շաքարային դիաբետ ուներ։ Հնարավոր է իրավիճակից էլ լիներ, հնարավոր է՝ ոչ, դա այս պահին ոչ ոք չի կարող ասել։ Սպասել ենք՝ հասկանալու, թե փրկել հնարավոր է արդյոք, թե ոչ, դատարանում խառնաշփոթ էր»,- ասել է փաստաբանը։ Նա գիշերը նաև այցելել է ՔԿՀ՝ տեսակցելու Նարեկ Սարգսյանին, ով մի քանի անգամ բժշկի է դիմել, քանի որ ինքնազգացողությունը վատացել է։

Հաջորդիվ՝ փաստաբանը հանցագործության մասին հաղորդում է ներկայացրել, որ քննություն իրականացվի, պարզեն՝ այդ տղան ինչ կապ կարող է ունենալ, ինչից դրդված, գուցե նա է արել, գուցե՝ ոչ։ Ի դեպ, այժմ պարզվել է այդ հայտարարությունն արած անձի ինքնությունը, վերջինս Նարեկ Սարգսյանի համագյուղացին է և ունի բարեկամական կապ։ Հաղորդումից զատ պաշտպանը պատրաստվում է դատարան հրատապ միջնորդություն ներկայացնել՝ պահանջելով հարցաքննել նշված անձին, այնուհետև, կմիջնորդի նաև փոխել խափանման միջոցը։
