Նիկոլ Փաշինյանը սոցիալ տնտեսական պատերազմ է հայտարարել հայ ժողովրդին և Հայաստանի Հանրապետությանը

«Հայաստանը ես եմ» նախաձեռնության ղեկավար Նաիրի Սարգսյանը ֆեյսբուքյան իր էջում գրել է․ 

ՀՀ Արդարադատության նախարարության կողմից շրջանառության մեջ է դրվել հերթական պետականակործան, բիզնեսաքանդ օրենքի նախագիծը, որը վերաբերում է ՀՀ վարչական դատավարության օրենսգրքում փոփոխություններ և լրացումներ կատարելուն։

Նախագծով առաջարկվում է ուժը կորցրած ճանաչել ՀՀ վարչական դատավարության օրենսգրքի 83-րդ հոդվածը, որոշակի փոփոխությունների ենթարկելով ՀՀ վարչական դատավարության օրենսգրքի 91-րդ հոդվածը։
Ըստ ներկայիս իրավակարգավորման, եթե անձը վիճարկման հայց է ներկայացնում դատարան, որն ընդունվում է վարույթ, ապա վիճարկվող վարչական ակտի կատարումը կասեցվում է, մինչև այդ հարցով վերջնական դատական ակտի ուժի մեջ մտնելը։

Օրինակ, եթե հարկային մարմնի կողմից տնտեսվարող սուբյեկտի նկատմամբ կազմվում է վարչական ակտ՝ տուգանք նշանակելու կամ այլ լրացուցիչ հարկային պարտավորությունների առաջադրման վերաբերյալ, ապա այդ ակտի վիճարկման նպատակով ներկայացված հայցը ՀՀ վարչական դատարանի կողմից վարույթ ընդունելու դեպքում այդ հարկային մարմնի ակտը ենթակա չէ կատարման (վճարման), մինչև դրա վերաբերյալ ՀՀ վարչական դատարանի կողմից կայացված վճռի կամ որոշման ուժի մեջ մտնելը։

Իսկ նոր կարգավորումներով, ստացվում է, որ անձը՝ լինի իրավաբանական, թե՝ ֆիզիկական, պետք է իր նկատմամբ կիրառված տուգանքը վճարի և նոր միայն բողոքարկի այդ ակտը։

Այսինքն, ստացվում է, մի հարկային տեսուչ կարող է բիզնեսին ապօրինի կերպով տուգանել 100 մլն, 1 մլրդ և այլն, դրամով, բիզնեսը պետք է վճարի տուգանքը, մարի հարկային պարտավորությունը, նոր միայն բողոքարկի ՀՀ Վարչական դատարան, որտեղ գործի քննությունը կարող է տևել 4 – 5 տարի։

Կամ ՀՀ քաղաքացի ֆիզիկական անձին Հարկային մարմինը, Պարեկային ծառայությունը և այլ պետական կամ տեղական ինքնակառավարման պարմինները անհիմն տուգանեն, ստիպված ՀՀ քաղաքացիները պետք է վճարեն տուգանքը, նոր միայն կարողանանան բողոքարկել ՀՀ Վարչական դատարան։

Նախագիծը ոչ այլ ինչ է, քան պատերազմ սեփական ժողովրդի և պետության դեմ։
