Իրավական մտքի հերթական «շեդեվրը»՝ ՆԳ նախարարության կատարմամբ․ Հովհաննես Քոչարյան

Հովհաննես Քոչարյանը ֆեյսբուքյան իր էջում գրել է․ 

Աննորմալ օրենսդրական նախաձեռնությունների շքերթը չի սահմանափակվում հարկային օրենսգրքով, պակաս «կտտանքների» չի ենթարկվում նաև զենքի մասին Հայաստանի Հանրապետության օրենսդրությունը։ Եվ այսպես՝ իրավական մտքի հերթական շեդեվրը ՆԳ նախարարության կատարմամբ. շրջանառության մեջ է դրվել մի օրինագիծ, համաձայն որի.

«Զենքի մասին» 1998 թվականի հուլիսի 3-ի ՀՕ-246 օրենքով կամ մինչև «Զենքի մասին» 1998 թվականի հուլիսի 3-ի ՀՕ-246 օրենքն ուժի մեջ մտնելը զենքով պարգևատրված կամ զենքով պարգևատրված համարվող բոլոր անձինք պարտավոր են մինչև 2025 թվականի հուլիսի 1-ը Հայաստանի Հանրապետության ոստիկանություն ներկայացնել պարգևատրական զենքերը, այդ թվում՝ մեկից ավելի անգամ պարգևատրված լինելու դեպքում՝ երկրորդ և հաջորդ միավոր բոլոր պարգևատրական զենքերը։

«Զենքի մասին» ՀՀ օրենքի 20-րդ հոդվածի 3.1-րդ մասի ուժով՝ որպես պարգև տրված զենքը պարգևատրվողին է հանձնվել սեփականության իրավունքով, ընդ որում՝ մալելուց հետո կարող էր ժառանգվել։ ՀՀ քաղաքացու սեփականությունը հարկադրաբար վերցնելու հիմքերը սահմանված են ՀՀ քաղաքացիական օրենսգրքի 279-րդ հոդվածով։ Հիմա հարց. ո՞ր հիմքերի տակ եք առբերել նախագծով ստեղծագործածը։ Եթե կարողանաք հիմնավորել, ապա փոխեք տեղեկանք-հիմնավորումը, եթե ոչ՝ նախագիծը հանեք շրջանառությունից։ Մինչ այդ՝ նախագծին պայմանական անուն տվեք, օրինակ Աշոտ Շայբոնի կամ Ժյուլ Վեռնի նախագիծ։
