Հանցավոր խումբը 30 անձից հափշտակել է 22 մլն դրամ և գույք

Ա.Ս.-ն հանցավոր խմբի կազմում կատարել է առանձնապես խոշոր չափերով խարդախություն՝ 30 անձից հափշտակելով 22 մլն 36 հզր ՀՀ դրամ գումար և գույք: Հայտնում են ՔԿ-ից:

Մասնավորապես՝ Ա.Ս.-ն իր կողմից հիմնադրված, սակայն առանց պետական գրանցման մի շարք իբր վարկային կազմակերպություններ ներկայացող գրասենյակների անունից ֆեյսբուքյան սոցիալական ցանցում գրանցված էջերի վճարովի թիրախային գովազդի միջոցով տարածել է շահավետ պայմաններով վարկեր տրամադրելու վերաբերյալ հայտարարություններ:

Հանցավոր խմբի անդամները հիշյալ հայտարարությունների հիման վրա իրենց դիմած և վարկեր ստանալու ցանկություն հայտնած անձանց հրավիրել են իբր վարկերի տրամադրման միջնորդ կազմակերպության գրասենյակներ և ներկայացրել, թե 30-35 տոկոս միջնորդավճարի դիմաց կարող են կազմակերպել տարբեր բանկերից և վարկային կազմակերպություններից նրանց անվամբ վարկային գումարների ուղղակի կամ անուղղակի ձևով ստացումը:

Այնուհետև, հանցավոր խմբի անդամները հիշյալ քաղաքացիներին ուղեկցել են տարբեր բանկեր, վարկային և առևտրային կազմակերպություններ, որտեղ վերցրել են նրանց տրամադրված վարկային գումարները, ապրանքները կամ դրանց ստացման կտրոնները՝ խաբեությամբ ներկայացնելով, թե անհրաժեշտ է կատարել վերջնահաշվարկներ, իրացնել ձեռք բերված ապրանքները, հաշվարկել միջնորդավճարների չափը, որից հետո ամբողջությամբ կտրամադրեն խոստացված գումարները, սակայն չեն տրամադրել և հափշտակել են:

Ա.Ս.-ն և խմբի մյուս անդամներն իրենց հանցավոր մտադրությունն իրականացնելու ընթացքում օգտագործել են նաև խաբեության այլ եղանակներ: Մասնավորապես՝ պարզել են իրենց դիմած քաղաքացիների անձնական տվյալները և նրանց անվամբ վճարային համակարգում գրանցել հաշիվներ, որոնց միջոցով վարկային ընկերությունից առցանց ստացել են վարկային գումարներ, սակայն, չարաշահելով քաղաքացիների վստահությունը, գումարները նրանց չեն տրամադրել, այլ, հասանելիություն ունենալով գրանցված հաշիվներին, կանխիկացրել և հափշտակել են:

Բացի այդ, հանցավոր խմբի անդամներն իրենց դիմած անձանց ուղեկցել են բանկի տարբեր մասնաճյուղեր, խաբեությամբ հաճախորդներից ստացել են բանկի հեռախոսային հավելվածի մուտքի տվյալները, որոնց միջոցով առցանց ստացած վարկային գումարները փոխանցել են այլ անձանց հաշիվներին և հետագայում կանխիկացնելու եղանակով հափշտակել դրանք:

Բացի այդ, Ա.Ս.-ն և Ա.Բ.-ն վարձակալել են 2 գրասենյակային տարածք՝ դրանցում առկա գույքով՝ իբր վարկային կազմակերպության զանգերի կենտրոնի գործունեությունն իրականացնելու համար։ Գրասենյակային տարածքների վարձակալության ժամկետի ավարտից հետո սեփականատերերը պարզել են, որ վարձակալող անձինք հափշտակել են գրասենյակային գույքը:

Ա.Ս.-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 255-րդ հոդվածի 3-րդ մասի 3-րդ կետով (առանձնապես խոշոր չափերով խարդախությունը) և 256-րդ հոդվածի 2-րդ մասի 1-ին կետով (մի խումբ անձանց կողմից նախնական համաձայնությամբ վստահված գույքը հափշտակելը) (երկու դրվագ):

Քրեական վարույթը մեղադրական եզրակացությամբ ուղարկվել է հսկող դատախազին՝ այն հաստատելու և դատարան ուղարկելու միջնորդությամբ։

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
