120 օր և ավելի կալանք` առանց հիմքերի. Կարեն Հակոբյանի գործի իրավական առեղծվածը. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Գործարար Կարեն Հակոբյանը 2024 թվականի սեպտեմբերի 20-ից, փաստաբանների գնահատմամբ՝ առանց որևէ հիմքի, ապօրինի ձևով անազատության մեջ է: Որոշակի իմաստով, կարելի է ասել, աննախադեպ իրավիճակ է ստեղծվել: Կարեն Հակոբյանը, որին մեղսագրվում է տնտեսական բնույթի հանցանք և որի նկատմամբ, ըստ փաստաբանների, չկա նույնիսկ մեկ մեղադրական ապացույց, գրեթե 120 օր կալանավորված է: Նման տևական ժամանակով կալանքը նման բնույթի մեղադրանքի պայմաններում նույնիսկ վերջին տարիների համար հազվադեպ երևույթ է:

Այս պնդումը հիմնավորվում է նաև նրանով, որ գործով անցնող մյուս բոլոր մեղադրյալները կալանվորված չեն: Ուշագրավ է, որ նույն գործով նույնիսկ ավելի ծանր մեղադրանքի պայմաններում մեկ այլ գործարար հենց առաջին ատյանի դատարանի որոշմամբ ազատվեց կալանքից: Պատահական չեն կարծիքները, որ այս գործի «պատվիրատուն» ակնհայտորեն հենց Նիկոլ Փաշինյանն է: Մի կողմից՝ նա հայտարարում է, որ կալանքի դեպքերը պիտի կրճատվեն, մյուս կողմից՝ փաստացի Կարեն Հակոբյանին 4 ամիս ապօրինի պահում են կալանքի տակ՝ առանց դրա անհրաժեշտության մասին վկայող հիմքերի, երբ դեռևս չկա ոչ մի դատավճիռ: Նման համոզմունք ունեցողները նշում են, որ սա ևս մեկ անգամ խոսում է այն մասին, որ թե՛ նախաքննական մարմինները և թե՛ ողջ դատական համակարգը դարձել են Նիկոլ Փաշինյանի կամակատարը՝ հանգեցնելով տոտալ իրավական ամենաթողության և օրենքների իսպառ բացակայության, ինչը չի կարող մնալ անհետևանք:

Ուշագրավ է նաև այն փաստը, որ վերաքննիչ դատարանի դատավոր Արթուր Նահապետյանը, ուժի մեջ թողնելով Կարեն Հակոբյանի կալանքի որոշումը, հաջորդ օրն իսկ նշանակվեց նոր պաշտոնի: Դրանից հետո սույն գործը մակագրվել էր մեկ այլ դատավորի՝ Վահե Դոլմազյանին, որը նույն այն դատավորն է, որը շուրջ 1,5 տարի ՀՀԿ փոխնախագահ Արմեն Աշոտյանին թողեց կալանքի տակ, այժմ էլ շարունակում է տնային կալանքի կիրառումը: Այս դատավորը 2 ամսով երկարաձգեց Կարեն Հակոբյանի կալանքը, և այս փաստը ևս անուղղակիորեն խոսում է այն մասին, որ դատավորի ընտրությունը ապահովում է Կարեն Հակոբյանի կալանքը որպես խափանման միջոց կիրառելու զուտ կամայական որոշումը:

Ստեղծված իրավիճակում Կարեն Հակոբյանը, որը «Վերածնվող Հայաստան» կուսակցության նախկին նախագահ, ԱԺ նախկին պատգամավոր Վահե Հակոբյանի եղբայրն է, նրա փաստաբանների համոզմամբ, շարունակում է մնալ իրավական կամայականությունների զոհ: «Պետք է ուղղակի արձանագրել, որ Հայաստանում «նոր իրավաբանություն» է կիրառվում, որի մասին, փաստորեն, դեռ մասնագետները տեղյակ չեն», -մեզ հետ զրույցում ասում էին Հակոբյանի փաստաբանները:
