Վերաքննիչը «Մաքուր երկաթ» գործարանի տնօրեն Կարեն Հակոբյանի կալանքի երկարաձգման որոշման դեմ բողոքը մերժել է. փաստաբան


Վարազդատ Հարությունյանը ֆեյսբուքյան իր էջում գրել է. 

Տեղեկացնում ենք, որ Վերաքննիչ քրեական դատարանը 2024թ․ սեպտեմբերի 20-ից ապօրինի կալանքի տակ գտնվող գործարար Կարեն Հակոբյանի կալանքի երկարաձգման որոշման դեմ բողոքը մերժել է, սակայն դատարանի որոշումը դեռևս չի հանձնվել պաշտպանական կողմին։ Ուշագրավն այն է, որ Վերաքննիչ քրեական դատարանում բողոքի բանավոր քննությունն իրականացվել և որոշման եզրափակիչ մասը հրապարակվել է 07.01.2025թ․, իսկ 08.01.2025թ․ դատավոր Արթուր Նահապետյանի լիազորությունները դադարեցվել են և վերջինս նշանակվել է ՀՀ քննչական կոմիտեի նախագահի տեղակալ։ Ստացվում է, որ որոշում կայացրած դատավորն արդեն աշխատում է որպես ՀՀ քննչական կոմիտեի նախագահի տեղակալ, սակայն դեռևս դատական ակտը չի տրամադրել պաշտպանական կողմին (ըստ նախկին դատավորի աշխատակազմի՝ պատրաստ չլինելու պատճառով)։

Ակնհայտ է, որ նույնիսկ բողոքի մերժման պայմաններում Դատարանը կարող է այնպիսի նոր դիրքորոշում արձանագրել, որը բխի պաշտպանության կողմի շահերից, հակառակը հնարավոր չէ այնքանով, որքանով Դատախազության կողմից որևէ բողոք չէր ներկայացվել: Սակայն մինչ օրս պաշտպանության կողմը զրկված է դրանից:

Գործարար, նախկինում չազատազրկված և չարատավորված Կարեն Հակոբյանի կալանքի երկարաձգման որոշման դեմ բողոքը, որը ներկայացվել էր դեռևս 2024թ․ նոյեմբերի 21-ին, Վերաքննիչ քրեական դատարանում քննվեց գրեթե մեկուկես ամիս՝ փաստացի կոպտորեն խախտելով ոչ միայն անձնական ազատության, այլ նաև Կարեն Հակոբյանի արդար դատաքննության իրավունքը։ Նախ՝ որոշման հրապարակումը նշանակված էր 2024թ․ դեկտեմբերի 19-ին, ապա այն հետաձգվեց 2024թ․ դեկտեմբերի 30-ին, դրանից հետո Դատարանը որոշում կայացրեց բողոքի քննությունը բանավոր ընթացակարգով իրականացնելու մասին, որը նախ նշանակվեց 2025թ․ հունվարի 9-ին, ապա տեղափոխվեց սույն թվականի հունվարի 7-ին: Բանավոր ընթացակարգի անցնելու վերաբերյալ որոշումը հիմնավորվում էր Դատարանի կողմից լրացուցիչ հանգամանքներ պարզելու անհրաժեշտությամբ, սակայն դատական նիստի ժամանակ Դատարանն այդպես էլ որևէ «լրացուցիչ» հանգամանք պարզելու փորձ չկատարեց։ Պաշտպանական կողմի համար այս եկրարաձգումների իրական պատճառը պարզ դարձավ արդեն նախկին դատավոր Արթուր Նահապետյանին նոր պաշտոնի նշանակելու վերաբերյալ տեղեկատվությունը ստանալուց հետո։

Հիշեցնենք, որ գործարար, նախկինում երբևէ չդատապարտված Կարեն Հակոբյանը մեղադրվում է առանձնապես խոշոր չափերով փողերի լվացման մեջ, սակայն մեղադրանքի հիմքում որևէ ապացույց առկա չէ և հիմնված է բացառապես ենթադրությունների, վարկածների վրա։
