Հայաստանը հաղթանակ է գրանցել արբիտրաժային վճռի չեղարկման գործով

Նոյեմբերի 5-ին կայացվել է «Ռասիա ՖԶէ-ն և Ջ. Բորկովսկին ընդդեմ Հայաստանի Հանրապետության» թիվ ARB/18/28 չեղարկման գործով որոշումը:

Ներդրումային վեճերի կարգավորման միջազգային կենտրոնում քննվող չեղարկման այս վարույթը հարուցվել էր հարավային երկաթուղու և արագընթաց ճանապարհի կառուցմանը վերաբերող վեճի առնչությամբ 2023թ. հունվարի 20-ին կայացված արբիտրաժային վճռի չեղարկման նպատակով: Հայցը ներկայացվել էր Հայաստանի Հանրապետության հետ կնքված կոնցեսիոն պայմանագրերի և «Հայաստանի Հանրապետության և Ամերիկայի Միացյալ Նահանգների միջև ներդրումների փոխադարձաբար խրախուսման և պաշտպանության մասին» պայմանագրի հիման վրա: Արբիտրաժային վճռով տրիբունալն ամբողջությամբ մերժել էր Հայաստանի դեմ ներկայացված շուրջ 331 միլիոն ԱՄՆ դոլար հայցապահանջը և պարտավորեցրել հայցվորներին հօգուտ Հայաստանի փոխհատուցել շուրջ 2,8 միլիոն ԱՄՆ դոլար՝ որպես իրավաբանական վճարների և ծախսերի, այդ թվում՝ արբիտրաժային վարույթի ընթացքում Հայաստանի կրած բոլոր ծախսերի փոխհատուցում:

Չեղարկման վարույթի շրջանակներում դիմումատուները հանձնաժողովից պահանջում էին չեղյալ հայտարարել արբիտրաժային վճիռը «Պետությունների և այլ պետությունների քաղաքացիների միջև ներդրումային վեճերի լուծման մասին» կոնվենցիայի 52-րդ հոդվածով նախատեսված հիմքերից երեքով՝ պնդելով որ՝ (1) տրիբունալն ակնհայտորեն գերազանցել է իր իրավասությունների շրջանակը, (2) ընթացակարգային հիմնարար կանոնից լուրջ շեղում է տեղի ունեցել, և (3) որոշման մեջ չեն նշվել դրա հիմքում դրված պատճառները: Դիմումատուների առանցքային պնդումն այն էր, որ տրիբունալը կոնցեսիոն պայմանագրերի հիման վրա ներկայացված հայցերի նկատմամբ չպետք է կիրառեր ՀՀ քաղաքացիական օրենսգրքով սահմանված հայցային վաղեմության կանոնները, իսկ դրանք կիրառելու արդյունքում թույլ է տվել այնպիսի խախտումներ, որոնք հիմք են վճիռը չեղարկելու համար:

Գրավոր դիրքորոշումների ներկայացման փուլում և լսումների ժամանակ Հայաստանը ներկայացրել է մանրամասն և համոզիչ փաստարկներ դիմումատուների պնդումների անհիմն լինելու և արբիտրաժային վճռի չեղարկման համար հիմք չհանդիսանալու վերաբերյալ: Ի վերջո, չեղարկման հանձնաժողովն ընդունելի է համարել Հայաստանի դիրքորոշումները և ամբողջապես մերժել է դիմումատուների պահանջները: Արդյունքում, հանձնաժողովը պարտավորեցրել է դիմումատուներին հատուցել չեղարկման վարույթի ընթացքում Հայաստանի Հանրապետության կրած իրավաբանական վճարներն ու ծախսերն ամբողջությամբ՝ ընդհանուր 382,248 ԱՄՆ դոլարի չափով: Նույն որոշմամբ Հայաստանն իրավասու է բռնագանձել արբիտրաժային վճռով բավարարված 2,8 միլիոն ԱՄՆ դոլարը չեղարկման վարույթի ընթացքում դիմումատուների կողմից հօգուտ Հայաստանի Հանրապետության ներկայացված երաշխիքից։

Չեղարկման վարույթի շրջանակներում Հայաստանի Հանրապետության շահերը ներկայացրել են՝ Alliance Law Partners իրավաբանական ընկերությունն՝ ի դեմս գործընկեր Էդվարդ (Թեդդի) Բոլդվինի, պրոֆեսոր Ֆրեդերիկ Սուղժանը և Միջազգային իրավական հարցերով ներկայացուցչի գրասենյակը:
