Պետական գաղտնիքի մասին օրենսդրությունը խախտելու համար պատիժը խստացվում է. խախտումները կքննի ԱԱԾ-ն

Վարչական իրավախախտումների վերաբերյալ օրենսգրքում լրացումներն ու փոփոխությունները պայմանավորված են պետական եւ տեղական ինքնակառավարման մարմիններում, կազմակերպություններում ու իրավաբանական անձանց մոտ գաղտնիության ռեժիմի ապահովման մակարդակի բարձրացման, ոլորտում հնարավոր իրավախախտումների կանխարգելման ու վերացման, գաղտնի տեղեկությունների արտահոսքին նպաստող պայմանները բացառելու անհրաժեշտությամբ:

Առաջարկվում է օրենսգրքում լրացնել նոր հոդված, որը պատասխանատվություն կնախատեսի պետական գաղտնիք պարունակող տեղեկությունների պահպանման բնագավառում օրենսդրության պահանջները չկատարելու համար:

ԱԺ պաշտպանության և անվտանգության հարցերի մշտական հանձնաժողովի նիստում օրենսդրական առաջարկը քննարկվել է առաջին ընթերցմամբ:

Կառավարության ներկայացուցչի խոսքով ամփոփվել են գաղտնի տեղեկությունների գաղտնագրման, պահպանության, գաղտնազերծման, ոչնչացման, գաղտնի գործավարության, համակարգչային տեխնիկայի միջոցով դրանց փոխանցման ընթացակարգերին վերաբերող հիմնական խախտումները՝ դրանց համար նախատեսելով համաչափ տուգանք: Նշվել է, որ տուգանքի չափը կարող է հասնել նվազագույն աշխատավարձի հիսունապատիկից մինչեւ վեցհարյուրապատիկի՝ կախված խախտման տեսակից:

Նախագծով լրացվող իրավախախտումները քննելու է ԱԱԾ-ն, իսկ ԱԱԾ-ի անունից վարչական իրավախախտումների վերաբերյալ գործեր քննելու եւ տույժեր նշանակելու իրավասություն ունեցող պաշտոնատար անձանց շրջանակը սահմանելու լիազորությունը կվերապահվի ԱԱԾ տնօրենին: Օրենսգրքում հաջորդ լրացմամբ կհստակեցվի պաշտոնատար անձանց վարչական պատասխանատվության շրջանակը՝ ներառելով նաեւ պետության անվտանգության ապահովման բնագավառը:

Պատգամավորների հարցերին ի պատասխան՝ զեկուցողը գլոբալ խնդիրներ չնշելով՝ փաստել է, որ գործող կարգավորումներով ԱԱԾ-ն մասնավոր կամ հանրային իշխանության մարմիններից մեկի մոտ գաղտնիության ռեժիմի խախտում հայտնաբերելիս սահմանափակվում էր բանավոր նախազգուշացմամբ: Ներգործության այլ միջոց չկար, որը կարող էր ամրապնդել այդ խնդրի՝ չկրկնվելու հանգամանքը, ինչն էլ իր հերթին կարող էր հետագայում գաղտնիության արտահոսքի պայմաններ ստեղծել:

Հանձնաժողովի նախագահ Անդրանիկ Քոչարյանն էլ կարեւորել է օրենքի ընդունման պարագայում դրա վերահսկողության պատշաճ իրականացումը, գաղտնի գործավարության պահանջների պահպանումը:
