Բնապահպանական իրավախախտումների համար հատուցված գումարի մեծ մասը կուղղվի բնության պահպանմանը. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Բնապահպանական իրավախախտումների հետևանքով կենդանական և բուսական աշխարհին պատճառված վնասի հատուցված գումարների մեծ մասն այլևս կուղղվի հատուկ պահպանվող տարածքների և դենդրոպարկերի պահպանությանն ու վերականգնմանը:

Իրավական ակտերի նախագծերի հրապարակման միասնական կայքում օրերս «Բնապահպանական իրավախախտումների հետևանքով կենդանական և բուսական աշխարհին պատճառված վնասի հատուցման սակագների մասին» օրենքում լրացում կատարելու մասին» օրենքի նախագիծն է շրջանառության դրվել, որը մշակվել է՝ նպատակ ունենալով բնապահպանական իրավախախտումների հետևանքով կենդանական և բուսական աշխարհին պատճառված վնասի հատուցման գումարների մի մասն ուղղորդել համապատասխան տարածքների՝ այդ թվում բնության՝ հատուկ պահպանվող տարածքների, դենդրոպարկերի առավել լավ պահպանությանն ու վերականգնմանը:

Մասնավորապես օրենքի 8–րդ հոդվածը, որտեղ ասվում է, որ «գանձված գումարը ուղղվում է պետական բյուջե» փոխարինվել է հետևյալ տողով. օրենքի համաձայն` «բնապահպանական իրավախախտումների հետևանքով կենդանական և բուսական աշխարհին պատճառված վնասի հատուցման գումարը գանձվում է պետական բյուջե՝ բացառությամբ սահմանված դեպքերի»:

Օրենքի նախագծով հստակ սահմանվում է, որ բնության հատուկ պահպանվող տարածքներում, դենդրոպարկերում, անտառպուրակներում կենդանական կամ բուսական աշխարհին պատճառված վնասի հատուցված գումարի հնգապատիկից քառապատիկն ուղղվում է տվյալ՝ բնության հատուկ պահպանվող տարածքի, դենդրոպարկի կամ անտառպուրակի պահպանությանն ու վերականգնմանը, իսկ միապատիկը գանձվում է պետական բյուջե: Արհեստական անտառներում, բնակավայրերի ընդհանուր օգտագործման վայրերի ծառատեսակների և թփերի ապօրինի հատման կամ ոչնչացման դեպքում հաշվարկված վնասի տասնապատիկից իննապատիկն ուղղվում է Երևան քաղաքի բյուջե, իսկ միապատիկը` պետական բյուջե, եթե, իհարկե, վնասը պատճառվել է Երևան քաղաքում, այլ համայնքների դեպքում՝ եռապատիկից կրկնապատիկն ուղղվում է համապատասխան համայնքի բյուջե, իսկ միապատիկը` պետական բյուջե:

Նախագիծը մշակվել է Բնապահպանության նախարարության աշխատակազմի իրավաբանական վարչության կողմից և, նախագծի հեղինակների կարծիքով, դրա ընդունմամբ բնության հատուկ պահպանվող տարածքների, դենդրոպարկերի և այլ տարածքների պահպանության և վերականգնման հարցերը կկարգավորվեն ավելի լավ:
