ԵԽԽՎ զեկույցը խոր մտահոգություն է արտահայտել ընդդիմադիր գործիչ Ավետիք Չալաբյանի դեմ հարուցված քրեական գործով. «ՀայաՔվե»

Եվրոպայի խորհրդի խորհրդարանական վեհաժողովի (ԵԽԽՎ) մշտադիտարկման հանձնաժողովը զեկույց է հրապարակել Հայաստանի ստանձնած պարտավորությունների կատարման վերաբերյալ, որում, ի թիվս այլոց, հատուկ անդրադարձ կա նաև «Հայաքվե» քաղաքացիական նախաձեռնության համակարգող Ավետիք Չալաբյանի նկատմամբ հարուցված քրեական գործին։
Զեկույցը խոր մտահոգություն է հայտնում առ այն, որ ՀՀ քրեական օրենսգրքի 236-րդ հոդվածի դրույթներն օգտագործվել են ընդդիմադիր քաղաքական գործիչ Ավետիք Չալաբյանին պատժելու նպատակով՝ 2022 թվականին ընդդիմության հավաքներին մասնակցելու համար ուսանողներին «նյութապես շահագրգռելու» մեղադրանքով։
Չալաբյանը երկուսուկես տարով զրկվել է հավաքներ կազմակերպելու և այլ հրապարակային միջոցառումներին կամ հավաքներին մասնակցելու, ինչպես նաեւ՝ բնակության վայրը փոխելու իրավունքից, ինչն ակնհայտորեն քաղաքականապես մոտիվացված հետապնդում է նրա նկատմամբ:
ԵԽԽՎ համազեկուցողները նկատում են, որ տվյալ դեպքում բողոքի ակցիաները կապված չէին ընտրարշավի հետ, այլ ընդամենը պահանջում էին Փաշինյանի հրաժարականը։ Հետևապես՝ ենթադրյալ արարքը ևս ընտրարշավի ֆինանսավորման հետ կապված չէր:
Խաղաղ հավաքների ազատության եվրոպական ուղեցույցի համաձայն՝ հավաքներին մասնակցելու նման խրախուսումը չի կարող քրեականացվել, և քրեական օրենսգրքի կիրառումն այս դեպքում ոչ իրավաչափ է։
Նման պատիժն, անշուշտ, արհեստական խոչընդոտ է հավաքների կազմակերպման համար, այստեղ առկա է նաև օրենքի կամընտրական կիրառման վտանգ։
Հայաստանի Հելսինկյան կոմիտեն և Քաղաքական իրավունքների հայկական կենտրոնն իրենց համատեղ զեկույցում ՀՀ կառավարությանը կոչ էին արել Քրեական օրենսգրքի այս հոդվածի փորձագիտական եզրակացության համար դիմել Վենետիկի հանձնաժողով։ ԵԽԽՎ համազեկուցողները ևս նշում են, որ նման պարզաբանման կարիք իսկապես կա, ուստի հարցն այժմ գտնվում է ՀՀ Կառավարության դաշտում, որի նախաձեռնությամբ ՀՀ Ազգային ժողովը 2022 թ. հունիսին այս վիճահարույց և փաստացի հակաժողովրդավարական փոփոխությունն է իրականացրել ՀՀ Քրեական օրենսգրքում:
