Դանակահարություն Մաշտոցի պողոտայում․ մեղադրանք է ներկայացվել 20-ամյա երիտասարդի

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Կենտրոն և Նորք-Մարաշ վարչական շրջանների քննչական առաջին բաժնում քննվող քրեական վարույթի շրջանակներում իրականացված քննչական և վարութային գործողությունների արդյունքում պարզվել են հունիսի 8–ին Երևան քաղաքի Մաշտոցի պողոտայում երկու անձի դանակահարության դեպքի մի շարք հանգամանքներ։

Հունիսի 8-ին՝ ժամը 01:59-ին, ապա նաև՝ 03,02-ին, «Հերացի թիվ 1 հիվանդանոցային համալիրից» հաղորդումներ են ստացվել Մաշտոցի պողոտայում գործող «Մալիբու» այգուց տարբեր աստիճանի մարմնական վնասվածքներով երկու երիտասարդներ տեղափոխվելու մասին, որոնցից մեկը՝ ծանր, մյուսը՝ բավարար վիճակում։

Դեպքի առթիվ նախաձեռնվել է քրեական վարույթ, որի շրջանակներում պարզվել է, որ 2024 թվականի հունիսի 8-ին՝ ժամը 01:24-ի սահմաններում, Երևան քաղաքի Մաշտոցի պողոտայում գործող «Սիզնս» ռեստորանի մոտակայքում միմյանց երկար նայելու հետ կապված վիճաբանություն է առաջացել երեք երիտասարդների միջև։ Դրա ընթացքում նրանցից Երևան քաղաքի 20–ամյա երկու բնակիչ, կոպտորեն խախտելով հասարակական կարգը, հայհոյանքներ հնչեցնելով, փոխադարձ հարվածներ են հասցրել միմյանց, այդ թվում նաև իրենց մոտ գտնվող դանակներով։ Նրանցից մեկը, իր հասակակցին ապօրինաբար կյանքից զրկելու դիտավորությամբ, իր մոտ գտնվող սուր կտրող-ծակող գործիքով բազմաթիվ հարվածներ է հասցրել վերջինիս կենսական նշանակության օրգաններին՝ պատճառելով կյանքի համար վտանգավոր ծանր մարմնական վնասվածքներ: Սակայն իր կամքից անկախ հանգամանքներով հանցագործությունն ավարտին չի հասցրել, քանի որ նրա գործողությունները կանխվել են վիճաբանությանը միջամտած քաղաքացիների կողմից, ինչպես նաև բուժհաստատություն տեղափոխվելուց հետո ցուցաբերված բժշկական միջամտության արդյունքում:

Ձեռք բերված բավարար փաստերի հիման վրա վարույթն իրականացնող մարմնի կողմից միջնորդություն է ներկայացվել հսկող դատախազին՝ 20–ամյա երիտասարդի նկատմամբ հանրային քրեական հետապնդում հարուցելու մասին, որը բավարարվել է, և նրան մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 44-155-րդ հոդվածի 1-ին մասով։

Նրա նկատմամբ կալանավորումը որպես խափանման միջոց կիրառելու միջնորդություն է ներկայացվել դատարան:

Ձեռնարկվում են անհրաժեշտ միջոցառումներ՝ դեպքի հանգամանքները պարզելու և առերևույթ հանցագործության մյուս մասնակիցների արարքներին քրեաիրավական գնահատական տալու ուղղությամբ:

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
