Հանրաքվեն կվերածվի՞ անվստահության գործընթացի. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Հանրային քննարկումների թեմաների մեջ այս օրերին առաջին տեղերից մեկում նոր Սահմանադրության ընդունման անհրաժեշտության մասին Նիկոլ Փաշինյանի հայտարարությունն է: Փորձագետներն ու քաղաքական գործիչները նշում են, որ նա այդպիսով կատարում է Ադրբեջանի պահանջներից մեկը և ցանկություն ունի ի մասնավորի Սահմանադրությունից հեռացնել Անկախության հռչակագրի մասին դրույթը: Սակայն օրերս «Ապրելու երկիր» կուսակցության նախագահ Մանե Թանդիլ յանը գրառում էր արել՝ հիշեցնելով, որ համաձայն Սահմանադրական դատարանի 2021 թվականի ապրիլի 29-ի ՍԴՈ-1590 որոշման, Սահմանադրության նախաբանը համարվում է անփոփոխելի դրույթ։ Այս մասին խոսել էին նաև քաղաքագետ Անդրանիկ Հովհաննիսյանը, այլ փորձագետներ, իրավաբաններ:

Ավելին, մասնագետները նշում են, որ Սահմանադրության 203-րդ հոդվածն արգելում է որևէ փոփոխություններ իրականացնել Սահմանադրության 1-3 հոդվածներում: Իհարկե, կան նաև կարծիքներ, որ փաշինյանական իրավաբանները կարող են այս ամենն այնպես մեկնաբանել, որ խոսքը ոչ թե փոփոխությունների, այլ նոր Սահմանադրության մասին է, ուստի նշյալ դրույթները չեն տարածվում: Ավելին, ըստ տեղեկությունների, այդ հանրաքվեն Փաշինյանը ցանկանում է օգտագործել ոչ միայն Ադրբեջանի պահանջները կատարելու կոնտեքստում, այլև ներքին լեգիտիմության ամրություն ցույց տալու համար:

Բայց մեզ հետ զրույցում մի քանի քաղաքագետներ այս օրերին նշում էին, որ Փաշինյանի այս հաշվարկները կարող են բացարձակ հակառակ ընթացք ունենալ, այսինքն՝ վերածվել «անվստահության հանրաքվեի» և ազգային ուժերի համախմբման հարթակ դառնալ՝ ընդդեմ ոչ միայն Սահմանադրության, այլև հենց Փաշինյանի, ինչը մեր զրուցակիցներից մեկը գնահատեց որպես պատմական շանս՝ «Նիկոլ Փաշինյանից ու նրա իշխանությունից ազատվելու և երկրի կործանման ընթացքը կանգնեցնելու համար»:
