Ո՞վ ո՞ւմ էր ուղարկել որոշումը և ինչո՞ւ․ «Փաստ»

«Փաստ» օրաթերթը գրում է.

Օրերս առիթ ունեցանք անդրադառնալու իրավական այնպիսի արտառոցությանը, ինչպիսին էր ԲԴԽ տարածած հրապարակային «պարզաբանումը» առ այն, թե ինչու է Արմեն Աշոտյանի «գործով» դատավոր Վահե Դոլմազյանը որոշում կայացրել ՀՀԿ փոխնախագահին պահել կալանքի տակ: Ընդգծել էինք, որ ԲԴԽ-ն իր այդ արտառոց պահվածքով ուղղակիորեն ապացուցեց, որ ՀՀԿ փոխնախագահ Արմեն Աշոտյանը քաղաքական բանտարկյալ է:

Արդեն երեկվա դատական նիստում Արմեն Աշոտյանը, ինչպես նաև նրա փաստաբանները դատավոր Վահե Դոլմազյանից ցանկանում էին ստանալ 1 (մեկ) պարզագույն հարցի պատասխան: Ուշադրությո՛ւն, հարցը. «Հարգարժան դատարան, այդ Դո՞ւք եք Ձեր կայացրած որոշումը տրամադրել դատական դեպարտամենտին, ԲԴԽ-ին: Այո՞, թե՞ ոչ»:

Դատավորի շուրթերից այդպես էլ հոդաբաշխ ու կոնկրետ պատասխան չհնչեց՝ ի՞նքն է որոշումը տրամադրել հիշյալ «պարզաբանիչ» կառույցին, թե՞ ոչ: Պատասխան կա, որ ոչինչ չի ասում: Բայց չպատասխան էլ կա, որ շա՜տ բան է ասում: Այստեղ «աղը», իսկ ավելի շուտ՝ «աղերը» հետևյալն են:

Առաջին. ինչպե՞ս է դատարանի որոշումը հայտնվել «պարզաբանիչ» ԲԴԽ տրամադրության տակ այն պարագայում, երբ պաշտպանական կողմին նույն այդ որոշումը տրամադրված չի եղել: Այստեղ գործ ունենք դատաիրավական տարրական էթիկայի խախտման հետ:

Երկրորդ «աղն» այն է, որ «պարզաբանողները» կատարել են անընդունելի մի բան, որի իրավասությունը չունեին, ըստ էության: Դա վկայում է այն մասին, որ այս ասպարեզում «բեսպրեդելը» մի այլ կարգի է ծաղկել, իսկ գործադիր իշխանության հրահանգներ կատարողները չեն էլ մտահոգվում, թե ինչպես, ինչ մեթոդներով են կատարում այդ հրահանգները:

Երրորդ. եթե դատավոր Դոլմազ յանն ինքն է իր որոշումը տրամադրել ԲԴԽ-ին, ըստ որում, նախքան այն դատավարական պաշտպանվող կողմին ներկայացնելը, ապա նա առնվազն պետք է ինքնաբացարկ հայտնի, քանզի այլևս չի կարող դիտարկվել որպես օբյեկտիվ կամ անկողմնակալ:

Բայց է՛լ ավելի վատ տարբերակ կա: Հնարավոր է՝ Արմեն Աշոտյանին կալանքի տակ պահելու որոշումը «թխել» է ոչ թե տվյալ դատավորը, այլ այն մարմինը, որը այդ որոշումը ափալ-թափալ «պարզաբանում» էր, և «ուղարկել» դատավորին: Եթե այո, ապա դա ուղղակի խայտառակություն է, «բեսպրեդելից» էլ այն կողմ:

Եվ, ի՞նչ իմանաս, գուցե ամենից առաջ հենց ա՞յդ պատճառով էր, որ երեկ դատավորն այդպես էլ որևէ պարզաբանում չտվեց՝ առաջարկելով դիմել ԲԴԽ-ին: Դժվար է միարժեքորեն պնդել, թե ԲԴԽ-ն հատկապես ինչի էր ձգտում իր «պարզաբանմամբ», բայց ակնհայտ է, որ այդպիսով բացի այն, որ ևս մեկ անգամ ապացուցեց, որ Արմեն Աշոտյանը քաղաքական բանտարկյալ է, նաև չափազանց անդուր խաղ խաղաց «յուրային» դատավորի ու նրա հեղինակության գլխին:
