ՄԻԵԴ-ի քաղաքական որոշումը. վարչախմբին երես են տալիս

Մարդու իրավունքների եվրոպական դատարանը երեկ հրապարակել է Հայաստանի Սահմանադրական դատարանի նախկին երեք դատավորներ՝ Ալվինա Գյուլումյանի, Հրանտ Նազարյանի, Ֆելիքս Թոխյանի ու ՍԴ նախկին նախագահ, ներկայումս դատարանի անդամ Հրայր Թովմասյանի գանգատների վերաբերյալ որոշումը։

Գործող իշխանությունները Սահմանադրական դատարանը յուրացնելու իրենց գործողությունների ընթացքում հեռացրել էին երեք դատավորների, իսկ Հրայր Թովմասյանին հանել ՍԴ նախագահի պաշտոնից, սակայն չէին կարողացել հեռացնել Սահմանադրական դատարանից։ Չորս դատավորները գանգատ էին ներկայացրել Մարդու իրավունքների եվրոպական դատարան, նշել, որ Հայաստանի կառավարությունը խախտել է իրենց իրավունքները՝ թույլ չտալով վերականգնել աշխատանքը, նաև պնդել, թե իրենց հանդեպ խտրականություն է դրսևորվել, ժամանակից շուտ են աշխատանքից ազատել։

Եվրոպական դատարանն իր որոշմամբ արձանագրել է, որ ներկայացված գանգատներում բարձրացված պահանջները կոնվենցիայի տեսանկյունից անընդունելի են՝ կոնվենցիայի կողմից պաշտպանության ենթակա իրավունքի բացակայության հիմքով։ Թեև դատավորներն իրենք ՄԻԵԴ որոշումները չեն մեկնաբանում, սակայն մասնագետները վստահ են, որ ՄԻԵԴ որոշումը քաղաքական ենթատեքստ ունի։ Արևմուտքը վերջին շրջանում զգալի ռեվերանսներ է անում Նիկոլ Փաշինյանի իշխանության հանդեպ, աչք փակում բոլոր տեսակ անօրինությունների նկատմամբ, ուստի և ամենայն հավանականությամբ ֆորա են տվել նաև ՄԻԵԴ վճիռների մասով՝ թույլատրելով Փաշինյանին վերաձևել իշխանությունն ըստ իր քմահաճույքի, փոխարենը, որ կատարի Արևմուտքի թելադրանքները, այլապես, առնվազն անլուրջ կլիներ կարծել, որ ՄԻԵԴ նախկին դատավոր Ալվինա Գյուլումյանն ու նրա գործընկերները կարող էին անհիմն հայց ներկայացնել Եվրադատարան։
