Ժողովրդի իշխանությունը յուրացրած բոլոր հանցագործները կրելու են անհատական պատասխանատվություն. Մենուա Սողոմոնյան

Մենուա Սողոմոնյանը ֆեյսբուքյան իր էջում գրում է. 

Դեկտեմբերի 5-ը՝ որպես Սահմանադրության ոտնահարման օր, որպես ժողովրդի իշխանությունը յուրացնելու հանցագործության օր, սևով կնշվի օրացույցում։

Երեկ՝ դեկտեմբերի 5-ին տեղի ունեցան սահմանադրական կարգի դեմ ուղղված երկու հանցագործություններ.

Առաջինը «ՀայաՔվե» քաղաքացիական օրենսդրական նախաձեռնության օրինագիծը ԱԺ նիստերի օրակարգ չմտցնելն էր. ՀՀ 58 հազար քաղաքացու կամաարտահայտությունն արհամարհվեց Ազգային Ժողովի ՔՊ խմբակցության կողմից։

Երկրորդը Ալավերդի համայնքում տեղի ունեցած իշխանազավթումն էր։ Օրենքի խախտմամբ գումարված նիստում, հարյուրավոր ոստիկանների կոպիտ ու կողմնակալ միջամտությամբ ավագանու ՔՊ խմբակցության ողջ կազմի և «Ապրելու երկիր» խմբակցության ճամբարափոխ մի անդամի համագործակցությամբ քաղաքապետ «կարգվեց» ևս մեկ ճամբարափոխ։

Երկու դեպքում էլ գործ ունենք Սահմանադրության 2-րդ հոդվածի ոտնահարման հետ։ Հոդվածն ասում է, որ ՀՀ-ում իշխանությունը պատկանում է ժողովրդին, որ ժողովուրդն իր իշխանությունն իրացնում է ընտրությունների, հանրաքվեների, պետական կառավարման և տեղական ինքնակառավարման մարմինների միջոցով, որ իշխանության յուրացումը անհատի կամ կազմակերպության կողմից հանցագործություն է։

Այսպիսով անգամ ՉՔՆՆԱՐԿՎԵՑ ժողովրդի քվեով Ազգային Ժողով մտած նախագիծը, ինչը Սահմանադրությամբ տրված սկզբունքի, իրավունքի ոտնահարում է (ՀՀ-ում ըստ Սահմանադրության, իրավունքի գերակայություն է)։ Իսկ Հայաքվեի բովանդակությունը վերաբերում է հենց Սահմանադրության պաշտպանությանը։ Երկրորդ հոդվածը ոտնահարվեց նաև Ալավերդի համայնքի ինքնակառավարման տապալման առումով։

Ժողովրդի իշխանությունը յուրացնելուն ուղղված առաջին հանցագործությունը կատարվեց ԱԺ ՔՊ չորս տասնյակ պատգամավորների կողմից, երկրորդ հանցագործությունը կատարվեց Ալավերդի համայնքի քպ-ական ավագանու 13 անդամների և մեկ ճամբարափոխի կողմից, դիտարկելի է նաև ոստիկանության ներկայացուցիչների արարքը։

Ժողովրդի իշխանությունը յուրացրած կազմակերպությունը «Քաղաքացիական պայմանագիր» կուսակցությունն է։
Ժողովրդի իշխանությունը յուրացրած բոլոր հանցագործները կրելու են ԱՆՀԱՏԱԿԱՆ պատասխանատվություն։
