Մեկ անձից գնումներ. պարբերաբար խախտում են օրենքներն ու սկզբունքները

Գործող վարչախումբը ժամանակին, երբ դեռ ընդդիմադիր էր, սիրում էր նախկին իշխանություններին քննադատել մեկ անձից գնումներ իրականացնելու համար։ 2018 թվականի հեղափոխությունից անցել է արդեն 5 տարի, իսկ փաշինյանական իշխանությունը և նրա ներկայացուցիչները վաղուց այլևս բազմաթիվ անգամներ գերազանցել են իրենց նախկիններին մեկ անձի գնումներ իրականացնելու գծով, ընդ որում, եթե ընդդիմադիր Նիկոլ Փաշինյանը քննադտում էր Սերժ Սարգսյանին՝ նշելով, թե մեկ անձից գնումներ իրականացնելու մեջ կոռուպցիոն բազմաթիվ ռիսկեր կան, ապա մոռացել է իր իսկ քննադատությունները, երբ խոսքը վերաբերում է անձամբ իր կուսակիցներին։

2022 թվականի տարեվերջին Երևանի ամանորյա լուսավորությունն ամենաքննարկվող թեմաներից էր, միայն դրա կազմակերպման վրա քաղաքային բյուջեից ծախսվել էր շուրջ 190 միլիոն ՀՀ դրամ։ Եվրատեսիլի նախօրեին, ժամկետից շուտ սկսելով տոնածառի և ամանորյա լուսավորության աշխատանքները, իշխանությունները փորձում էին համոզել, թե խնդիրը միայն միջազգային մրցույթը պատշաճ կերպով ներկայացնելն է։ Այս տարի որևէ միջազգային մրցույթ Հայաստանում չի նախատեսվում, փոխարենը քաղաքապետարանը կրկին ժամկետից շուտ սկսել է իրականացնել Երևանի լուսավորության աշխատանքները և կրկին մեկ անձից գնումով։

Փոխքաղաքապետ Սուրեն Գրիգորյանը երեկ կայացած ասուլիսում փորձում էր համոզել, թե որևէ կոռուպցիոն ռիսկ չկա, որևէ խնդիր չկա, որ մեկ անձից է գնումն իրականացվում, բայց այդպես էլ համառորեն չէր նշում, թե որքան գումար է նախատեսվում ծախսել նման լուսավորության համար, մինչդեռ գնումների մասին ՀՀ օրենքի 18-րդ հոդվածը հստակ սահմանում է գնում կատարելու ընթացակարգերը՝ նշելով, որ գնման ենթակա ապրանքը, աշխատանքը, կամ ծառայությունը հնարավոր է ձեռք բերել միայն մեկ անձից, որը պայմանավորված է նրա հեղինակային և հարակից իրավունքներով՝ հատուկ, կամ բացառիկ իրավունքի առկայությամբ, կամ էլ արտահերթ, կամ չնախատեսված այլ իրավիճակի առաջացման հետևանքով։

Ընդհանրապես օրենքը հստակ և պարզ է, մեկ անձից գնումների դեպքում, որևէ պարագայում Երևանի արտաքին լուսավորությունը մեկ անձի հանձնելու որոշումն օրենքի այս կետի մեջ չի տեղավորվում, փոխարենը հայտնի է, որ Երևանում լուսավորությունն իրականացնելու է մեկ ընկերություն «Սինեմարտ» ՍՊԸ-ն, որի միակ բաժնետերն ու տնօրենը Հանրային հեռուստաընկերության ռազմավարական ծրագրերի պատասխանատու Ռուբեն Շահինյանն է։
