Որդու ծառայակցին տեսակելու գնացող ամուսինները վթարի են ենթարկվել ու մահացել

1in.am / Արմավիրի մարզի ընդհանուր իրավասության դատարանում Արթուր Ադամյանի նախագահությամբ ավարտվել է Լյուբիշա

Ստանիսլավլևիչի գործի դատական քննությունը:

57-ամյա Լյուբիշա Ստանիսլավլևիչը ազգությամբ սերբ տղամարդ է, բնակվել է Սերբիայի Նիշ քաղաքում, աշխատել է սերբական «Դոկա Դոլևաց» ֆիրմայում՝ որպես վարորդ, վարել է ընկերությանը պատկանող «Վոլվո» մակնիշի բեռնատար՝ կցորդով: Լյուբիշան իրականցրել է բեռնափոխադրումներ:

2016 թվականի դեկտեմբերին Սերբիայում գործող «Դոկա Դոլևաց» ընկերությունը եվրոպական արտադրության դռների, պատուհանների ու մահճակալների պատվեր է ստացել Հայաստանի Հանրապետությունից:

Լյուբիշա Ստանիսլավլևիչը 4 տոննա ապրանքով բեռնված իր բեռնատարով ուղևորվել է Հայաստան:

2016 թվականի դեկտեմբերի 16-ին, ժամը 18-ն անց 30-ի սահմաններում Լյուբիշան իր բեռնատարը վարել է Արմավիր-Երևան ավտոճանապարհով՝ շուրջ 70 կմ/ժ արագությամբ:

Գործով տուժող ամուսիններ Սիմոնն ու Նվարդը բնակվում էին Արմավիրի մարզի Հովտամեջ գյուղում: Սիմոնը վարում էր իր անձնական օգտագործման «Ֆոլքսվագեն» մեքենան:

Դեպքի օրը՝ 2016 թվականի դեկտեմբերի 16-ին, ժամը 18-ի սահմաններում նրանք իրենց մեքենայով ուղևորվել են Արմավիրի մարզի Ակնալիճ գյուղ՝ իրենց զինվոր որդու համածառայակցին տեսակցելու նպատակով:

Ժամը 18-ն անց 30-ի սահմաններում Երևան-Արմավիր ավտոճանապարհի 21-րդ կիլոմետրի հատվածում սերբ Լյուբիշայի՝ 4 տոննա բեռով բարձված բեռնատարը սառած ճանապարհի վրա կորցրել է կառավարումը, դուրս է եկել հանդիպակաց ուղեմաս ու բախվել է Սիմոնի «Ֆոլքսվագեն» մեքենային:

Վթարից հետո սերբական բեռնատարին են բախվել նաև դեպի Արմավիր ընթացող երկու «Օպել» մեքենաներ:

Վթարի հետևանքով ամուսիններ Սիմոնն ու Նվարդը ծանր վնասվածքներ են ստացել: Նվարդը մահացել է, իսկ Սիմոնը տեղափոխվել է հիվանդանոց, որտեղ 4 օր անց՝ դեկտեմբերի 20-ին նույնպես մահացել է:

Դատարանում Լյուբիշա Ստանիսլալևիչն իրեն լիովին մեղավոր է ճանաչել ՀՀ քրեական օրենսգրքի 242 հոդվածի 3-րդ մասով՝ վարորդի կողմից ՃԵԿ պահանջները խախտելը, որն առաջացրել է 2 կամ ավելի մարդկանց մահ:

Գործը ամբաստանյալի միջնորդությամբ քննվել է արագացված ընթացակարգով:

Տուժողի իրավահաջորդը քաղհայցի պահանջ չի ներկայացրել, խնդրել է ամբաստանյալի նկատմամբ մեղմ պատիժ նշանակել…

Դատարանը Լյուբիշա Ստանիսլավլևիչին մեղավոր է ճանաչել ու դատապարտել է 4 տարի 6 ամիս ազատազրկման՝ տրանսպորտային միջոցներ վարելու իրավունքից զրկելով 2 տարի ժամկետով:

Պատժի սկիզբը՝ 2016 թվականի դեկտեմբերի 16-ից: Պատիժը կրում է ՀՀ ԱՆ քրեակատարողական հիմնարկում:

Երբ դատավճիռն օրինական ուժի մեջ մտնի՝ Լյուբիշայի վարած «Վոլվո» բեռնատարն իր կցորդով կվերադարձվի սերբական «Դոկա Դոլևաց» ընկերությանը:
