Լրատվամիջոցներն իրենց դեմ հայցի ու արդեն կայացված դատական վճռի մասին իմացել են հայցվորի՝ Հակոբ Արշակյանի գրառումից. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Բարձր տեխնոլոգիական արդյունաբերության նախկին նախարար, այժմ Ազգային ժողովի փոխնախագահ Հակոբ Արշակյանն օրերս տեղեկացրել է, որ ընդդեմ ArmDay.am և Lurer.com լրատվական կայքերի դեմ իր ներկայացրած հայցով դատարանը «հրապարակային եղանակով կատարված արտահայտությունները գնահատել է զրպարտող»: Նշենք, որ դատարանը հայցը բավարարել է մասնակի, նշյալ լրատվամիջոցներին պարտավորեցրել է հրապարակայնորեն հերքել խնդրո առարկա տեղեկությունները, ինչպես նաև համապարտության կարգով Արշակյանին վճարել 500 հազար դրամ փոխհատուցում և 35 հազար դրամ՝ որպես վճարված պետական տուրք։ Նախ՝ ուշագրավ է, որ Հակոբ Արշակյանը այս վճռի մասին բարձրաձայնում է դրա ընդունումից մոտ մեկ ամիս անց (վճիռը կայացվել է սեպտեմբերի 8-ին):

Երկրորդ՝ պատասխանողների ներկայացուցիչները չեն մասնակցել դատական քննությանը, ինչի մասին, ի դեպ, նշված է դատարանի վճռում: «Փաստ» թերթի տեղեկություններով, նշյալ լրատվամիջոցները նույնիսկ տեղյակ չեն եղել, որ իրենց դեմ հայց է ներկայացվել դատարան: Ընդ որում, հայցն առաջին անգամ դատարան է ուղարկվել վճռի կայացումից 15 ամիս առաջ: Այդ ողջ ընթացքում ոչ մի անգամ որևէ ծանուցում չեն ստացել: Ավելին, նրանք չեն ստացել նաև դատարանի վճիռը, որպեսզի կարողանան բողոքարկել կամ կատարել այն, իսկ դրա մասին տեղեկացել են Հակոբ Արշակյանի սոցցանցային գրառումից:

Ճիշտ է, դատարանն իր վճռում նշում է, որ դատական ծանուցագրերը ետ են վերադարձվել փոստային առաքանու ետ վերադարձի կտրոններում նշված համապատասխանաբար՝ «Տեղափոխված» և «Չպահանջված» գրառումներով, և դրանով փաստորեն համարել է իր պարտավորությունը կատարած, սակայն փաստը մնում է փաստ, որ պատասխանողները որևէ ծանուցում երբեք չեն ստացել: Չեն ստացել նաև որևէ զանգ՝ ո՛չ դատարանից, ո՛չ առաքող կազմակերպությունից, թեպետ հեռախոսահամարները լրատվամիջոցներում նշված են: Թե ինչպես է դա եղել, ում մեղքով, արդեն լուրջ ուսումնասիրության հարց է:

Ի դեպ, հավելենք, որ այս վճռի կապակցությամբ եզրակացություն է հրապարակել Ինֆորմացիայի ազատության կենտրոնը՝ մասնավորաբար նշելով, որ դատարանի՝ փոխհատուցման հետ կապված եզրահանգումը հիմք է տալիս կարծելու, որ փոխհատուցման չափը որոշելիս դատարանը հետապնդել է ոչ թե հայցվորի վնասը համարժեքորեն հատուցելու, այլ պատասխանող լրատվամիջոցներին պատժելու քողարկված նպատակ։ Խորհուրդը նաև գտնում է, որ կայացված դատական ակտով տեղի է ունեցել պատասխանող լրատվամիջոցների արտահայտվելու ազատության անօրինական միջամտություն, որով խախտվել է նրանց՝ տեղեկություններ ու գաղափարներ տարածելու իրավունքը։
