Որպեսզի գոնե կալանքի միջոցով «պատժվեն»․ «Փաստ»

«Փաստ» օրաթերթը գրում է.

Արդեն «բարի ավանդույթ» է դարձել, որ ընդդիմադիրները, ընդդիմախոսները, երբ որևէ թեթև քայլ են կատարում, առերևույթ չնչին զանցանք են թույլ տալիս կամ նույնիսկ մի թթու խոսք են ասում իշխանությունների և հատկապես Նիկոլ Փաշինյանի հասցեին, անմիջապես քրեական վարույթ է նախաձեռնվում և իրավական գործընթաց սկսվում տվյալ անհատի նկատմամբ։ Ավելին, 2018 թվականից սկսյալ կալանավորումը դարձել է Նիկոլ Փաշինյանի սիրելի գործիքակազմը. ըստ իրավաբանների, 2018-2023 թվականներին աննախադեպ քանակով է կիրառվել փախանման այդ միջոցը, մեծամասամբ՝ քաղաքական ենթատեքստով գործերով: Խոսքը թե՛ հայտնի ընդդիմադիր քաղաքական գործիչների մասին է, թե՛ տարբեր ակցիաների ժամանակ ընդդիմադիրների բերման ենթարկելու, ապա և կալանավորելու, թե՛ սոցցանցային գրառումների մասին:

Վերջին քաղաքական իրադարձությունների ֆոնին ևս իշխանությունների «սրտի դատավորները» մեծ հաճույքով փախանման միջոց են ընտրում կալանքը կամ երկարացնում են նախկինում արդեն տրված կալանքի ժամկետը։ Ընդ որում, այս ամենը տեղի է ունենում այն ֆոնին, որ ոչ քիչ դեպքերում ընդդիմադիր հայացքներ ունեցողների նկատմամբ են սոցցանցերում հայհոյել, բռնության կոչեր արել, վիրավորել, նույնիսկ ակնհայտ բռնություն կիրառել, այդ թվում՝ առողջությանը վնաս պատճառելով։ Ավելին, որոշ դեպքերում անգամ հայտնի են եղել, թե ովքեր են դրանց իրականացնողները, սակայն, այդուհանդերձ, այդ դեպքերով անգամ ձերբակալություն չի եղել։ Դրա վառ օրինակը բոլորովին վերջերս Արթուր Չախոյանի հետ կապված հայտնի միջադեպն էր, երբ նրա կյանքին ակնհայտ սպառնացող անձը չձերբակալվեց։

Սրան գումարենք այն հանգամանքը, որ ընդդիմադիրների անհնազանդության ակցիաների ժամանակ բռնարարք կատարած որևէ ոստիկան առ այսօր չի ենթարկվել որևէ պատասխանատվության։ Փոխարենը, հարյուրավոր անձինք բերման են ենթարկվել ոստիկանության բաժիններ, իսկ ճնշող դեպքերում նրանց նկատմամբ ոստիկանության կողմից կիրառվել է անհամաչափ ուժ: Այդ օրերի ընթացքում բազմաթիվ անձինք ենթարկվել են վարչական պատասխանատվության, շուրջ 70 անձ ապօրինի ձերբակալվել է, մի քանի տասնյակ անձինք կալանավորվել են: Արդյունքում, ինչպես շատ փաստաբաններ են նշում, ՔԿՀ-երում ուղղակի տեղ չկա։ Այն, որ Նիկոլ Փաշինյանը կալանքը դարձրել է պատժի միջոց, նորություն չէ. այդ մասին պարբերաբար բարձրաձայնում են ոլորտի մասնագետները:

Դրա համար նշվում են տարբեր պատճառներ: Դրանցից ամենահիմնականը, մեր ունեցած տեղեկություններով, վերաբերում է հետևյալին. իշխանությունները հիանալի հասկանում են, որ երբ ընդդիմադիրների ու ընդդիմախոսների նկատմամբ կարված այդ «գործերը» հասնեն դատարան, իսկույն պարզ է դառնալու, որ դրանց գերակշիռ մեծամասնությունը սարքված է, այդ գործերը փլուզվելու են, իսկ «մեղադրյալներն» արդարացվելու են: Սակայն Նիկոլ Փաշինյանը չի կարող հանդուրժել, որ իր ընդդիմախոսները մնան անպատիժ, ուստի մեծամասնության նկատմամբ որպես խափանման միջոց կիրառվում է կալանքը, որպեսզի գոնե այդ երկու կամ չորս ամիսը նրանց համար համարվի պատիժ:
