ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Աջափնյակ և Դավթաշեն վարչական շրջանների քննչական բաժնում իրականացված քննությամբ բացահայտվել է օգոստոսի 5-ին «Վահագնի» ռեստորանային համալիրում կատարված ավազակային հարձակման դեպքը։

2023թ. օգոստոսի 5-ին Երևան քաղաքի բնակիչը հաղորդում է տվել այն մասին, որ նույն օրը՝ ժամը 04:00-ի սահմաններում, գտնվել է աշխատանքի վայրում՝ Երևան քաղաքի Աշտարակի խճուղում գործող «Վահագնի» ռեստորանային համալիրում, որտեղ մուտք են գործել երկու դիմակավորված անձինք, իրեն կապկպել են կպչուն ժապավենով։ Նրանցից մեկը, ատրճանակի նմանվող առարկայի սպառնալիքով, սրահից գողացել է դրամատուփը և մի քանի խմիչքներ, որից հետո դիմել են փախուստի:

Դեպքի առթիվ նույն օրը ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Աջափնյակ և Դավթաշեն վարչական շրջանների քննչական բաժնում, ՀՀ քրեական օրենսգրքի 252-րդ հոդվածի 2-րդ մասի 3-րդ, 5-րդ, 6-րդ կետերի և 335-րդ հոդվածի 1-ին մասի հատկանիշներով, նախաձեռնվել է քրեական վարույթ:

ՀՀ ՆԳՆ ոստիկանության աշխատակիցների ձեռնարկված օպերատիվ հետախուզական միջոցառումների, ինչպես նաև կատարված նախաքննության արդյունքում պարզվել է, որ ավազակային հարձակումը կազմակերպել և կատարել են 1994թ. ծնված, Գյումրիի բնակիչ Ա.Գ.-ն, 1983թ. ծնված, Սևան քաղաքի բնակիչ Հ.Ղ.-ն և 1980թ. ծնված, ՌԴ քաղաքացի Ա.Ու.-ն։ Վերջիններս հայտնաբերվել են Երևան քաղաքի Մաշտոցի պողոտայում գտնվող խանութներից մեկում, ձերբակալվել և ներկայացվել վարույթն իրականացնող մարմնին։

Դատարանի համապատասխան որոշմամբ խուզարկություն է իրականացվել նշված անձանց փաստացի բնակության վայրում, որտեղից, ի թիվս այլ առարկաների, հայտնաբերվել են հափշտակության առարկա հանդիսացող իրերը:

2023թ. օգոստոսի 6-ին որոշումներ են կայացվել՝ Հ.Ղ.-ի և ՌԴ քաղաքացի Ա.Ու.-ի նկատմամբ ՀՀ քրեական օրենսգրքի 252-րդ հոդվածի 3-րդ մասի 4-րդ կետով, իսկ Ա. Գ.-ի նկատմամբ ՀՀ քրեական օրենսգրքի 46-252-րդ հոդվածի 3-րդ մասի 4-րդ կետով հանրային քրեական հետապնդում հարուցելու մասին, և նրանց ներկայացվել է մեղադրանք:

Միջնորդություններ են ներկայացվել Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության քրեական դատարանին` նշված երեք անձանց նկատմամբ որպես խափանման միջոց կալանք կիրառելու մասին, որոնք բավարարվել են։

Նախաքննությունը շարունակվում է:

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
