Ո՞ր դատավորներն են ԲԴԽ-ի հաջորդ թիրախը. «Փաստ»

«Փաստ» օրաթերթը գրում է

ՀՀ վճռաբեկ դատարանի քաղաքացիական պալատի դատավոր Սուրեն Անտոնյանի լիազորությունների դադարեցման օպերացիան, որը համակարգում գնահատվում է ապօրինի, բարեհաջող կերպով ավարտին հասցնելուց հետո, մեր ունեցած տեղեկություններով, քաղաքական իշխանությունն այժմ թիրախավորել է նույն պալատի դատավորներ Արտակ Բարսեղյանին և Տիգրան Պետրոսյանին: Արդարադատության նախարար-ԲԴԽ նախագահ զույգը կրկին անցել է գործի. առաջինի միջնորդությամբ երկրորդի գլխավորած կառույցը առաջիկայում կքննի սնանկության դատարանի դատավոր Սամվել Թադևոսյանին, վերաքննիչ քաղաքացիական դատարանի դատավոր Աստղիկ Խառատյանին, Վճռաբեկ դատարանի քաղաքացիական պալատի դատավորներ Արտակ Բարսեղյանին և Տիգրան Պետրոսյանին կարգապահական պատասխանատվության ենթարկելու հարցը:

Վարույթի հիմքում կրկին ՄԻԵԴ վճիռներից մեկն է, այս անգամ՝ 2019 թվականի հունվարի 24-ի վճիռը: Նախարարը միջնորդել է դատավորներին պատժել 2009 թվականին, այսինքն՝ 14 տարի առաջ կայացված դատական ակտերի համար: Ուշագրավ է, որ արդարադատության նախարարության վերահսկողական ծառայության պետը նախարարի «ուսումնասիրմանն» է ներկայացնում այնպիսի վճիռներ, որտեղ բացակայում են Գրիգոր Մինասյանի և Կարեն Անդրեասյանի նախընտրելի դատավորները: Քրեական արդարադատության բնագավառում էլ, բացի Մնացական Մարտիրոսյանի մասնակցությամբ գործից, կարծես թե, քրեական գործերով ՄԻԵԴ-ի այլ վճիռներ չեն հանդիպել: Դատական համակարգի և փաստաբանական համայնքի շատ ներկայացուցիչներ նշում են, որ հաշվի առնելով քրեական արդարադատության պահանջված լինելը (Ժորա Չիչոյանն էլ՝ վկա)՝ պարզ է դառնում այս բնագավառում գործող դատավորներին սիրաշահելու շարժառիթը:

Ըստ ոլորտի մասնագետների, ՄԻԵԴ վճիռների օգտագործմամբ դատական համակարգի գրավման գործընթացն, այսպիսով, շարունակվում է, և քաղաքական իշխանության թողտվության պայմաններում այն հաջողությամբ ավարտվելու դեպքում կունենանք իշխանություններին լիովին հնազանդ Վճռաբեկ դատարան: Միջազգային իրավունքի փորձագետները կարծում են, որ ԲԴԽ-ի կողմից որդեգրված այս քաղաքականությունը հղի է համակարգային ծանր հետևանքներով, քանի որ ՄԻԵԴ ներկայացված դիմումների բավարարման դեպքում բավականին մեծ բեռ է դրվելու Հայաստանի Հանրապետության վրա, ինչը, կարծես, բացարձակ չի հետաքրքրում օրվա իշխանություններին:
