«Նա հեղինակավոր հովանավորներ չուներ և պատժվեց». 15-ամյա հանդբոլիստի սպանության գործով արդարացվածը դատապարտվեց 7 տարով

Tert.am-ը գրում է.

Վերաքննիչ քրեական դատարանն երեկ մասնակիորեն բավարարել է մեղադրող դատախազի վերաքննիչ բողոքն ու Վանաձորում 15-ամյա հանդբոլիստ Դավիթ Հովակիմյանի սպանության մեջ մեղադրվող Կարեն Կունգուրցևին դատապարտել 7 տարվա ազատազրկման: Լոռու մարզի առաջին ատյանի դատարանը հանցակազմի բացակայության հիմքով արդարացրել էր Կարեն Կունգուրցևին և ազատ արձակել դատական նիստերի դահլիճից:

Այս մասին Tert.am-ին հայտնեց փաստաբան Արայիկ Պապիկյանը.«Նախ Վերաքննիչ քրեական դատարանը փոխեց մեղադրանքը: Մեղադրող դատախազը բողոք էր բերել, որ Կարեն Կունգուրցևին մեղավոր ճանաչեն ՀՀ քր. օր-ի 34-104 հոդ. 1-ին մասով (սպանության փորձ) նախատեսված հանցանքը կատարելու մեջ և դատապարտել ազատազրկման 9 տարի 6 ամիս ժամկետով, սակայն վերաքննիչը փոխեց մեղադրանքը և Կարեն Կունգուրցևին մեղավոր ճանաչեց ՀՀ ՔՕ-ի 112-րդ 2-րդ մասի 14 կետով՝ դիտավորությամբ առողջությանը ծանր վնաս պատճառելը,որն անզգուշությամբ առաջացրել է տուժողի մահը: Սա ապտակ էր դատախազությանը, որը վստահ էր, որ տեղի ունեցածը սպանության փորձ է: Վերաքննիչը փաստացի ասաց՝ դուք մոլորության մեջ եք»:

Պաշտպանը նաև հայտնեց, որ այդ գործի շրջանակներում բժիշկ է ազատազրկվել, որը, ըստ մեղադրանքի՝ ժամանակին պատշաճ օգնություն չի ցուցաբերել:
