Հայաստանի պաշտպանության նախարարությունը նոր նախագիծ է դրել հանրային քննարկման, որով առաջարկվում է ներդնել պայմանագրային զինվորական ծառայության նոր համակարգ, ինչպես նաև շարքային կազմի կարճաժամկետ պարտադիր զինծառայություն՝ ՀՀ պետական բյուջե գումար վճարելու պայմանով:

Հիմնավորման մեջ նշվում է, որ օրենքի նախագծի ընդունումը պայմանավորված է ՀՀ կառավարության 2021-2026թթ. ծրագրին համապատասխան պայմանագրային զինվորական ծառայություն անցնելու գրավչությունն ու շահագրգռվածությունը բարձրացնելու, արհեստավարժ պայմանագրային զինվորական ծառայության զարգացման համար նախադրյալներ ստեղծելու, շարքային կազմի պարտադիր զինվորական ծառայության փոխարեն շարքային և սպայական կազմերի պարտադիր զինվորական ծառայությունից պայմանագրային զինվորական ծառայության անցման նոր համակարգ և շարքային կազմի կարճաժամկետ պարտադիր զինծառայության ընթացակարգ ներդնելու անհրաժեշտությամբ:

ՀՀ կառավարության 2021-2026թթ. ծրագրով նախատեսվել է աստիճանական և կանոնակարգված ձևով պարտադիր զինվորական ծառայության ժամկետի կրճատման օրենսդրական հիմքերի ստեղծում, որի շրջանակներում, հաշվի առնելով նաև մի շարք օտարերկրյա պետությունների փորձը, առաջարկվում է շարքային կազմի պարտադիր զինվորական ծառայության որոշակի ժամկետը և, դրանով պայմանավորված՝ զինծառայողի պատրաստության ուսումնական փուլը լրանալու դեպքում (միջինը՝ չորսուկես ամիս), զինծառայողի կողմից ՀՀ պետական բյուջե 24 մլն դրամ վճարելու պայմանով, զինծառայողին պարտադիր զինվորական ծառայությունից վաղաժամկետ արձակելու հնարավորություն: Նշված գումարի չափը նախատեսվել է նաև այն տրամաբանությամբ, որ մեկ պարտադիր զինծառայողի փոխարեն 5 տարի ժամկետով հնարավորություն է ընձեռվելու պայմանագրային զինծառայողին հաշվարկել մինչև 400.000 դրամ ամսական վարձատրություն, ինչը արհեստավարժ զինվորական ծառայության համակարգ ներդնելու մոտիվացիոն կարևորագույն բաղադրիչ է: Գործընթացը փոխկապակցված է նաև մարտական և դրան հավասարեցված խնդիրների իրականացման, պլանավորման կամ վերահսկման գործառույթներ ունեցող պաշտոններ զբաղեցնող պայմանագրային զինվորական ծառայության սպայական, ենթասպայական և շարքային կազմերի զինծառայողների ատեստավորման ու դրա հիման վրա լրավճարների սահմանման համակարգի ներդրման հետ:

«Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին ՀՀ օրենքի նախագիծը հրապարակվել է e-draft.am կայքում:
