Այն, ինչ կատարվում է Ավետիք Չալաբյանի հետ, իրավական «բեսպրեդել» է. իրավապաշտպան

Ավետիք Չալաբյանի մեղադրանքի ու քրեական գործի հետ կապված որևէ քննարկում անիմաստ է, որովհետև այն շինծու գործ է և բացարձակապես չի համապատասխանում որևէ միջազգային նորմի: Այս ամբողջ քրեական գործն ուղղակի քաղաքական հետապնդում է Ավետիք Չալաբյանի նկատմամբ:

Past.am-ի հետ զրույցում նման կարծիք է հայտնել Հայաստանի «Հելսինկյան կոմիտեի» նախագահ Ավետիք Իշխանյանն՝ անդրադառնալով «Արար» հիմնադրամի համահիմնադիր, հասարակական գործիչ Ավետիք Չալաբյանին կրկին կալանավորելու որոշմանը:

Խոսելով բուն կալանքի մասին՝  նա հավելեց. «Առհասարակ Եվրոպայի խորհրդի, եվրոպական կառույցների կողմից Հայաստանին ուղղված հորդորն է եղել այն, որ կալանքը պետք է կիրառվի շատ առանձին դեպքերում: Տվյալ դեպքում ևս ուղղակի ծիծաղելի է խոսել կալանքի հիմքերի մասին, որովհետև հատկապես հիմա՝ կապված այս վերջին կալանքի հետ, նախաքննությունն ավարտված է: Այսինքն, Ավետիք Չալաբյանը չէր կարող որևէ կերպ խոչընդոտել այդ շինծու քրեական գործին: Մեծ հաշվով՝ տվյալ դեպքում գործ ունենք «բեսպրեդելի» հետ: Այն, ինչ կատարվում է  Ավետիք Չալաբյանի հետ, իրավական «բեսպրեդել» է: Խոսքը թե՛ քրգործի, թե՛ նախորդ և թե՛ օգոստոսի 3-ին կիրառված կալանքի մասին է»:

Ավետիք Իշխանյանը նշեց, որ օգոստոսի 3-ին կալանքը կիրառելու ժամանակ ձևական մի ներկայացում եղավ:

«Դատախազությունը, իբր առանձին ու անկախ համակարգ, առաջարկեց ոչ թե կալանք, այլ գրավ կիրառել: Ու հանկարծ «անկախ» դատարանը որոշում է, որ՝ ոչ, պետք է կալանք կիրառել: Սա ներկայացում էր, բեմադրություն, որովհետև թե՛ դատախազությունը, թե՛ դատավոր Մնացական Մարտիրոսյանը Նիկոլ Փաշինյանի ստրուկներն են: Ընդհանուր առմամբ, այս ամենը բռնակալական հակումներ ունեցող մեկ անձի ցանկությունն է: Ընդդիմադիր հայացքներ ունեցող գործիչներին կալանավորելը, տանջելը, խոշտանգելը նրա պատվերներն են՝ թեկուզև նրանք մահանան, ինչպես Արմեն Գրիգորյանը, Մանվել Գրիգորյանը: Անգամ մահերը նրան որևիցե կերպ չեն հետաքրքրում»,-եզրափակեց Ավետիք Իշխանյանը:
