«Չալաբյանին նորից կալանավորելու նպատակը նրա առողջությանը լուրջ վնաս հասցնելն է». Մենուա Սողոմոնյան

Դատավորի կողմից  Ավետիք Չալաբյանին երեք ամսով կալանավորելու որոշումը կարող եմ որպես  արտակարգ դատարան դառնալու դրսևորում գնահատել: Այս մասին Past.am-ի հետ զրույցում նշեց «5165» շարժման համահիմնադիր, ԵՊՀ դոցենտ Մենուա Սողոմոնյանը՝ անդրադառնալով Ավետիք Չալաբյանի կալանավորմանը:

«ՀՀ Սահմանադրությամբ արգելվում է արտակարգ դատարանների գոյությունը, իսկ այս քայլը տեղավորվում է արտակարգ դատարանի տրամաբանության մեջ: Արտակարգ դատարանի կայացրած վճիռների, որոշումների հիմքում օրենքը, Սահմանադրությունը չէ: Արտակարգ դատարաններն առաջնորդվում են տվյալ ժամանակաշրջանի ղեկավարության նպատահարմարությամբ: Այսպիսի քայլով Մնացական Մարտիրոսյանը տվյալ դատարանը վերածեց արտակարգ դատարանի: Ավետիք Չալաբյանին կրկին կալանավորելը հակասահմանադրական է: Այս ամենը պարզորոշ ցույց է տալիս դատական իշխանության ուղղակի կախվածությունը քաղաքական ղեկավարությունից»,-ասաց մեր զրուցակիցը:

Նա շեշտեց, որ բազմաթիվ իրողություններ ցույց են տալիս, որ Հայաստանում  անկախ դատական համակարգ գոյություն չունի. «Իհարկե, ոչ բոլոր դատավորների մասին է խոսքը, բայց այնպիսի տխրահռչակներ, ինչպես Մնացական Մարտիրոսյանն է, իրենց գործունեությամբ պարզապես ծառայում են մեկ մարդու՝ Նիկոլ Փաշինյանին: Հիմա ի՞նչը կարող է լինել Մնացական Մարտիրոսյանի՝ նման գործողությունների դրդապատճառը: Ավետիք Չալաբյանը ևս հարցրեց՝ ո՞րն է Մ. Մարտիրոսյանի  աշխատանքի մոտիվացիան: Նախ՝ այս դատավորը նախկինում էլ էր հայտնի՝ որպես իշխանությունների կամքը կատարող: Նրա վրա, ըստ էության, հիմա ճնշում է գործադրվում, որովհետև նա նաև Նիկոլ Փաշինյանին էր դատել: Քաղաքական իշխանությունը նրան անել է տալիս այն, ինչ ցանկանում է: Մ. Մարտիրոսյանն այսօրվա իշխանությանը պետք է, քանի որ նրանց իշխանությունը պահպանելու գործառույթ է իրականացնում»:

Նրա խոսքով, Ավետիք Չալաբյանի կալանավորումն ու իշխանությունը պահպանելու խնդիրն ուղիղ կապ ունեն. «Ի  դեմս Ավետիք Չալաբյանի՝ Փաշինյանն իր իշխանության համար լուրջ հակառակորդի, լուրջ մրցակցի է տեսնում: Ավետիք Չալաբյանը բազմաթիվ համեմատական առավելություններ ունի իր նկատմամբ՝ կապված թե՛ մասնագիտական կապերի, թե՛ բազմաթիվ հաջողությունների, թե՛ նաև համակարգային գործունեության հետ: Բացի այդ, Ավետիք Չալաբյանը հանդես է գալիս իր ազգակործան օրակարգին հակընդդեմ, այդ օրակարգը բացառող լուրջ օրակարգով: Երրորդ՝ Փաշինյանը հնարավորություն չունի Չալաբյանի հրապարակային գործունեությանը հակադրվել թալանի, գռփելու և այլ պիտակավորումների տեսքով: Հետևապես մնում է վախի, ահակաբեկման ու առողջությանը վնաս հասցնելու միջոցը կիրառել: Ավետիք Չալաբյանին 3 ամսով կալանավորելու նպատակը նրա առողջությանը լուրջ վնաս հասցնելն է, որպեսզի Չալաբյանը վնասված առողջությամբ դադարի հրապարակային գործունեություն իրականացնել»:

Հիշեցնենք, որ օգոստոսի 3-ին «Արար» հիմնադրամի համահիմնադիր, հասարակական գործիչ Ավետիք Չալաբյանը նորից կալանավորվեց, այս անգամ՝ երեք ամսով։
