Քաղաքացին ազատվել է 13 տարվա կալանքից և նոր հանցանք կատարել․ դատախազություն

Արձանագրվել է հերթական դեպքը, երբ վարույթն իրականացնող քննիչի կամ դատախազի կողմից կալանքի հետ կապված միջնորդություններով կալանավորման հիմքերի առկայության վերաբերյալ ներկայացված պատշաճ հիմնավորումների, փաստարկումների պարագայում դատարանի որոշման արդյունքում մեղարդյալը, հայտնվելով ազատության մեջ, կատարել է նոր հանցանք, գրում է ՀՀ գլխավոր դատախազության հանրային կապերի բաժինը։

ՀՀ ՔԿ Արարատի մարզային քննչական վարչությունում քննվող քրեական գործով  2022թ. հունիսի 4-ին Ա. Բ.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 38-267.1-րդ հոդվածի 4-րդ մասի 1-ին կետով և 268-րդ հոդվածի 3-րդ մասով: Նախաքննությամբ հիմնավորվել է, որ նա քննությամբ դեռևս ինքնությունը չպարզված անձի միջոցով ԻԻՀ մի քաղաքացու 490.000 ՀՀ դրամ գումար տալով, վերջինիս դրդել է ՀՀ պետական սահմանով` մաքսանենգ ճանապարհով իրեն իրացնել առանձնապես խոշոր չափերով թմրամիջոցներ: 2022 թ. հունիսի 1-ին Ագարակ քաղաքի և ԻԻՀ պետական սահմանի մոտ առկա առաջին չգործող թունելի մոտ, իր անձնական օգտագործման համար ապօրինի ձեռք է բերել առանձնապես խոշոր չափերով` ընդհանուր 86.9 գրամ քաշով «Մեթամֆետամին» տեսակի թմրամիջոց, որը հայտնաբերվել է վերջինիս անձնական խուզարկությամբ:
Առաջադրված մեղադրանքում Ա. Բ.-ն իրեն մասնակի մեղավոր է ճանաչել, նրա նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը:

Քրեական գործի նախաքննության ընթացքում, սակայն պարզվել է, որ  մինչ այդ, ՀՀ ՔԿ ԵՔՔՎ Էրեբունի և Նուբարաշեն վարչական շրջանների քննչական բաժնում քննվող այլ քրեական գործով Ա. Բ.-ն 2021թ. դեկտեմբերի 7-ից ներգրավված է որպես մեղարդյալ ՀՀ քրեական օրենսգրքի 266-րդ հոդվածի 1-ին մասով նախատեսված հանցանք կատարելու համար:
2021թ. դեկտեմբերի 8-ին ՀՀ Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի որոշմամբ նրա նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը, սակայն  հետագայում դատարանը մերժել է կալանավորման ժամկետը երկու  ամիս ժամկետով երկարացնելու վերաբերյալ վարույթն իրականացնող մարմնի միջնորդությունը, և անձն ազատ է արձակվել: 

Հետագայում այս որոշումը ՀՀ դատախազությունը բողոքարկել է նաև ՀՀ վերաքննիչ դատարան, որը մերժել է բողոքը:  

Դատարանները, շեշտը դնելով վարույթն իրականացնող մարմնի կողմից գործի քննության ընթացքն ապահովելու հարցում պատշաճ ջանասիրություն չցուցաբերելու անհիմն հանգամանքի վրա՝ անտեսել են միջնորդություններով մանրամասն ներկայացված՝ կալանքի հիմքերի, մասնավորապես՝ ազատության մեջ մնալու դեպքում նոր հանցավոր արարք կատարելու բարձր հավանականության և այդ պարագայում ցանկացած այլ խափանման միջոցի կիրառման պարագայում մեղադրյալի պատճշաճ վարքագիծը երաշխավորելու անհնարինության մասին փաստական տվյալները: Մասնավորապես՝ անտեսվել է այն հանգամանքը, որ Ա. Բ.-ն մինչ այդ առանձնապես ծանր հանցագործություն (բանդիտիզմ) կատարելու համար դատապարտվել է ազատազրկման 13 տարի ժամկետով և ենթադրյալ ծանր հանցագործության համար այդ պահին մեղադրվում է պատժի կրումից պայմանական վաղաժամկետ ազատվելուց հետո: 

Նման պայմաններում վարույթն իրականացնող մարմնի կողմից մեղադրյալի նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն չհեռանալու մասին, ինչից հետո, փաստորեն, գտնելով ազատության մեջ, նա կատարել է առանձնապես խոշոր չափերով թմրամիջոցի մաքսանենգությանը հանցակցության և առանց իրացնելու նպատակի ապօրինի շրջանառության վերոնշյալ հանցավոր արարքը:
