Դատարանը բավարարել է Ծաղկաձորում անօրինական կերպով աճուրդով օտարված հողատարածքը պետությանը վերադարձնելու դատախազության հայցը

«Հետք» էլեկտրոնային թերթի 2018թ. սեպտեմբերի 28-ի «Պաշտոնյաները Ծաղկաձորում 60 հա անտառ են սեփականաշնորհել» վերտառությամբ հրապարակման հիման վրա հարուցված քրեական գործի շրջանակներում ՀՀ գլխավոր դատախազությունը, հայտնաբերելով պետական շահերի խախտման փաստը, 2019-2020թթ. պետական շահերի պաշտպանության հայց է ներկայացրել դատարան ընդդեմ ՀՀ Կոտայքի մարզպետարանի և մյուսների, որոնց շրջանակներում վիճարկել է Կոտայքի մարզի համայնքների վարչական սահմաններից դուրս գտնվող թվով 25 հողամասի վերաբերյալ 2007թ.կայացված աճուրդները՝ պահանջելով կիրառել հետևանքներ: Այս մասին տեղեկացնում է՝ ՀՀ դատախազության հանրային կապերի բաժինը:

ՀՀ Կոտայքի մարզի ընդհանուր իրավասության առաջին ատյանի դատարանը կայացրած վճռով բավարարվել է ՀՀ գլխավոր դատախազության կողմից ներկայացված հայցն ընդդեմ Կոտայքի մարզպետարանի և նշված հողամասերից մեկը օրենսդրության խախտմամբ իրականացված աճուրդով ձեռք բերած Զ. Գ.-ի: Մասնավորապես, դատարանի վճռով անվավեր է ճանաչվել 26.05.2007թ. կայացած այդ հողամասի աճուրդը և որպես դրա հետևանք՝ անվավեր է ճանաչվել նաև Կոտայքի մարզպետի և նշված անձի միջև 31.05.2007թ. կնքված հողամասի առուվաճառքի պայմանագիրը, դրա հիման վրա 0,55 հա տվյալ հողամասի նկատմամբ անձի սեփականության իրավունքի պետական գրանցումը:

Դատարանը քաղաքացուն նաև պարտավորեցրել է Հայաստանի Հանրապետությանը վերադարձնել տվյալ հողամասը, իսկ Կոտայքի մարզպետարանին պարտավորեցրել է նրան վերադարձնել անվավեր ճանաչված հողամասի առուվաճառքի պայմանագրի գինը կազմած 3.435.500 ՀՀ դրամը:

Դատարանի այս որոշումը կարևոր նշանակություն ունի նույնպիսի սխեմայով իրականացված՝ Ծաղկաձորում գտնվող մյուս հողամասերի աճուրդներն անվավեր ճանաչելու, պետության խախտված գույքային իրավունքները վերականգնելու դատախազության նախաձեռնած իրավական գործընթացի համար:

Դեռևս դատարանի վարույթում են գտնվում թվով 24 հողամասերի աճուրդն անվավեր ճանաչելու և հետևանքներ կիրառելու վերաբերյալ ՀՀ դատախազության ներկայացրած հարցեը, որոնք քննության արդյունքների վերաբերյալ հետագայում նույնպես հանրությունը կտեղեկացվի:
