Ամբողջ իրականությունը Արգամ Աբրահամյանի առանձնատան վաճառքի վերաբերյալ

Երեմ Սարգսյանը ֆեյսբուքյան իր էջում գրում է.
 
Քանի որ ՀՀ հակակոռուպցիոն կոմիտեն և ՀՀ գլխավոր դատախազությունը վստահորդիս՝ Արգամ Աբրահամյանի առանձնատան հետ կապված իրենց հայտարարություններն ու պարզաբանումներն արդեն իսկ ներկայացրեցին, ուստի որպես Արգամ Աբրահամյանի ներկայացուցիչ, ներկայացնեմ մեր դիրքորոշումը։
 
Այսպես, Արգամ Աբրահամյանին սեփականության իրավունքով պատկանող առանձնատան նկատմամբ քննիչի գրության հիման վրա կադաստրի կոմիտեում սահմանափակում էր կիրառվել, որի պատճառով Արգամ Աբրահամյանը երկարատև զրկված էր իր սեփականությունն անարգել տնօրինելու իրավունքից, որպիսի իրավունքը երաշխավորված է ՀՀ Սահմանադրությամբ։
 
Արգամ Աբրահամյանի սեփականության իրավունքի խախտումը վերացնելու նպատակով բողոք ենք ներկայացրել դատարան և դատարանն իրավացիորեն գտնելով, որ բողոքը հիմնավոր է, այն բավարարել է՝ քննիչին պարտավորեցնելով վերացնել Արգամ Աբրահամյանի իրավունքների խախտումները։
 
Արդյո՞ք եթե դատախազը դատարանի որոշման դեմ վերաքննիչ բողոք է ներկայացրել, ապա դատարանի որոշման ի կատար ածումը պետք է կասեցվեր։
Իհարկե՝ ՈՉ։
 
Ընդհակառակը՝ քննիչը պարտավոր էր ԱՆՀԱՊԱՂ վերացնել Արգամ Աբրահամյանի իրավունքի՝ արդեն իսկ երկարատև խախտումը, քանզի ՀՀ քրեական դատավարության օրենսգրքի 427-րդ հոդվածի 1-ին մասով շատ հստակ սահմանված է, որ առաջին ատյանի դատարանի` գործն ըստ էության չլուծող դատական ակտն ՈՒԺԻ ՄԵՋ Է ՄՏՆՈՒՄ ԿԱՅԱՑՄԱՆ ՊԱՀԻՑ:
 
Իսկ օրինական ուժի մեջ մտած դատական ակտը պարտադիր ենթակա է կատարման ցանկացած պաշտոնատար անձի կողմից: Ավելին, այն դիտավորյալ չկատարելը նույնիսկ քրեական պատասխանատվություն է առաջացնում։
 
Ինչ վերաբերում է ՀՀ դատախազության այն պարզաբանմանը, որ վերաքննիչ բողոք ներկայացնելուց հետո այդ դատական ակտի ի կատար ածումը պետք է կասեցվեր ՀՀ քրեական դատավարության օրենսգրքի 103-րդ հոդվածի 4-րդ մասի հիմքով, ապա հարկ է հատուկ ընդգծել, որ այդ նորմը սահմանված է հետևյալ կերպ․ «Սույն օրենսգրքով նախատեսված դեպքերում բողոք տալը կասեցնում է բողոքարկվող որոշումն ի կատար ածելը»։
 
Այսինքն, որպեսզի սույն դեպքում դատախազի կողմից վերաքննիչ բողոք ներկայացնելը կասեցներ առաջին ատյանի դատարանի որոշման ի կատար ածումը, ապա դա հատուկ պետք է նախատեսված լիներ օրենսգրքով, որպիսի որևէ նորմ օրենսգրքում չի նախատեսվել, ինչի մասին քաջատեղյակ է նաև դատախազությունը, հակառակ դեպքում այդ նորմը կվկայակոչեր իր պարզաբանման մեջ։
 
Իսկ ինչ վերաբերում է դատախազության պարզաբանման այն հատվածին, թե վերջին տարիներին ձևավորվել է կայուն պրակտիկա, ըստ որի՝ գործն ըստ էության չլուծող դատական ակտերի դեմ բողոք տանելը կասեցնում է դրանց կատարումը, մինչև վերադաս դատարանի կողմից որոշման կայացումը, ապա հարկ է նշել, որ որևէ անօրինական պրակտիկա չի կարող արդարացնել օրենքի սխալ կիրառումն ու անձի սահմանադրական իրավունքների խախտումները։
