Գերությունից վերադարձած ու կալանավորված զինծառայողները վրդովված են․ վերաքննիչ բողոք են ներկայացրել

Դեկտեմբերի 4-ին Հայաստան վերադարձված գերիներից լեյտենանտ Սերժիկ Ամիրխանյանի և պայմանագրային զինծառայող Ռոբերտ Նալբանդյանի կալանավորման դեմ վերաքննիչ բողոք է ներկայացվել։ Այս մասին ԼՈՒՐԵՐ․com-ի հետ զրույցում ասաց վերադարձած գերիների շահերի ներկայացուցիչներից փաստաբան, «Իրավական ուղի» հասարակական կազմակերպության համահիմնադիր Ռուբեն Մելիքյանը՝ նշելով, որ սպասում են նիստերին և լիահույս են՝ դրանք կլինեն մինչև այս տարվա վերջ։

Նա նշեց՝ իր պաշտպանյալները չեն ընդունում մեղքը և վիրավորված են Հայաստանի Հանրապետության դրսևորած վերաբերմունքից․ «Նրանք ոչ միայն չեն ընդունում իրենց մեղքը, այլ նաև վրդովված են։ Քրեական հետապնդումն իրավաչափ չէ և իրենց համար ընկալելի չէ, թե ինչպես կարող են իրենց նկատմամբ կալանքը որպես խափանման միջոց ընտրել», - ասաց փաստաբանը։ 

Ինչ վերաբերում է հարցին, թե արդյոք դիրքապահներին եղե՞լ է չկրակելու հրաման, որի վերաբերյալ վերջին շրջանում բուռն քննարկումներ են գնում՝ Մելիքյանը չանդրադարձավ՝ ընդգծելով, որ այն նախաքննական գաղտնիքի բովանդակություն ունի․ «Այս մարդկանց նկատմամբ մեծագույն անարդարություն է իրականացվում և նրանց ճակատագիրը մեր հասարակական կազմակերպության համար ունի շատ կարևոր նշանակություն։ Այդ մասին անպայման կխոսենք, բայց այն ժամանակ, երբ առավելագույն արդյունավետություն լինի», - նշեց Մելիքյանը։ 

Նշենք, որ կալանավորված 4 գերիներից 2-ի շահերի ներկայացուցիչներն են նաև փաստաբաններ Սիրանուշ Սահակյանն ու Դավիթ Գալստյանը։ 

Հիշեցնենք, որ նոյեմբերի 16-ին Հայաստանի արևելյան դիրքերի ուղղությամբ ադրբեջանական հարձակման հետևանքով հայ զինծառայողներ էին գերեվարվել։ Նրանցից 10-ը դեկտեմբերի 4-ին Ռուսաստանի միջնորդությամբ վերադարձել էին Հայաստան։ Նրանցից 5-ին մեղադրանք է առաջադրվել, որոնցից 4-ը դատարանի որոշմամբ կալանավորվել են, մեկը՝ ոչ։ Վերջինի մասով ՔԿ-ն վերաքննիչ բողոք է ներկայացրել։ Նրանց մեղադրանք է առաջադրվել քրեական օրենսգրքի 365 հոդվածի 3-րդ մասով՝ մարտական հերթապահություն կամ մարտական ծառայություն կրելու կանոնները խախտելը, որն առաջացրել է ծանր հետևանքներ։
