ՄՊՀ-ում տեղի է ունեցել զեղչերի և այլ ակցիաների իրականացման ոլորտի օրենսդրական բարեփոխումներին նվիրված քննարկում

Մրցակցության պաշտպանության հանձնաժողովի նախաձեռնությամբ այսօր քննարկում էր հրավիրվել զեղչերի և այլ ակցիաների իրականացման ոլորտի օրենսդրական բարեփոխումների վերաբերյալ: Միջոցառմանը մասնակցում էին ՄՊՀ նախագահ Գեղամ Գևորգյանը, հանձնաժողովի անդամներ Տիգրան Մարկոսյանը և Շուշան Սարգսյանը, հանձնաժողովի այլ պատասխանատուներ:

ՄՊՀ նախագահ Գեղամ Գևորգյանը նշել է, որ առաջարկվող օրենսդրական բարեփոխումները նպատակ ունեն կանխարգելել զեղչերի և ակցիաների ոլորտում առկա անբարեխիղճ մրցակցության դեպքերը, որոնք նաև օրենսդրական բացերի պատճառով են տեղի ունենում, և ստեղծել կանխատեսելի և մրցակցային միջավայր թե՛ բիզնեսի, թե՛ սպառողների համար:

ՄՊՀ նախագահի խոսքով՝ 2021 թվականի ընթացքում հանձնաժողովը 20-ից ավելի վարույթներ է հարուցել զեղչերի և այլ ակցիաների ոլորտում հասարակության մոլորեցմամբ անբարեխիղճ մրցակցության դրսևորումների հատկանիշներով:

Նախագծերով մի շարք առանցքային փոփոխություններ են առաջարկվում: Մասնավորապես սահմանվում է պահանջ, համաձայն որի հայտարարված զեղչի ամենաբարձր տոկոսը պետք է կիրառվի ակցիային մասնակցող ապրանքների կամ ծառայությունների առնվազն մեկ հինգերորդի նկատմամբ: Այսինքն՝ եթե տնտեսավարողը, օրինակ մինչև 70 տոկոս զեղչ է հայտարարում, ապա առաջարկվող փոփոխությամբ ակցիային մասնակցող ապրանքների կամ ծառայությունների առնվազն մեկ հինգերորդի, այսինքն՝ 20 տոկոսի վրա պետք է 70 տոկոս զեղչ կիրառվի:

Մեկ այլ փոփոխությամբ զեղչը պետք է հաշվարկվի հայտարարման պահին նախորդող երկու ամիսների ամենացածր գնի նկատմամբ, ինչը նպատակ ունի կանխարգելելու դեպքերը, երբ զեղչից առաջ գների բարձրացում էր կատարվում, այնուհետև զեղչ կիրառվում:   Ակցիան պետք է ունենա ժամանակային սահմանափակում, ակցիան և գնիջեցումը պետք է լինեն տարբերակված:

ՄՊՀ անդամ Տիգրան Մարկոսյանը նշել է, որ օրակարգում ներառված հարցերը զգայուն են և՛ բիզնեսի, և՛ սպառողների իրավունքների պաշտպանության տեսանկյունից, այդ պատճառով հանձնաժողովը, կարևորելով շահագրգիռ անձանց մոտեցումներն ու առաջարկները նախապես լսելու անհրաժեշտությունը, այս քննարկումները նախաձեռնել է մինչև նախագծերը պաշտոնական շրջանառության մեջ դնելը:

Քննարկման ընթացքում տնտեսավարողները մի շարք հարցադրումներ բարձրացրեցին, որոնց վերաբերյալ պարզաբանումներ ստացան պատասխանատուներից, ինչպես նաև առաջարկներ ներկայացրեցին նախատեսվող փոփոխությունների մասին:

Ամփոփելով քննարկման արդյունքները՝ ՄՊՀ անդամ Տիգրան Մարկոսյանն առաջարկեց առկայության դեպքում մինչև 2022 թվականի հունվարի 10-ը գրավոր առաջարկներն ուղարկել հանձնաժողովի պաշտոնական [email protected]  էլ. փոստի հասցեով:
