ՀՀ ԱԺ պատգամավորության թեկնածուին մեղադրանք է առաջադրվել ընտրակաշառք տալու համար

2021թ. հունիսի 26-ին ՀՀ ոստիկանության Եղեգնաձորի բաժնում օպերատիվ տեղեկություններ են ստացվել այն մասին, որ Վայոց ձորի մարզի Գլաձոր համայնքի Վերնաշեն բնակավայրի բնակիչը ընտրակաշառք է տվել նույն համայնքի Գլաձոր բնակավայրի մի բնակչուհու, որպեսզի վերջինիս ընտանիքի անդամները 2021թ. հունիսի 20-ին կայացած Ազգային ժողովի արտահերթ ընտրությունների ժամանակ քվեարկեն «Պատիվ ունեմ» դաշինքի օգտին:

Դեպքի առթիվ ՀՀ ոստիկանության Եղեգնաձորի բաժնում 2021թ. հունիսի 26-ին ՀՀ քրեական օրենսգրքի 154.2-րդ հոդվածի 1-ին և 2-րդ մասերի հատկանիշներով հարուցվել է քրեական գործ:
Ըստ քննչական ենթակայության՝ քրեական գործը նախաքննություն կատարելու համար ուղարկվել է ՀՀ հատուկ քննչական ծառայություն:

Նախաքննության ընթացքում պարզվել է, որ ԱԺ արտահերթ ընտրություններին մասնակցող «Պատիվ ունեմ» կուսակցությունների դաշինքի պատգամավորի թեկնածուների ցուցակում ընդգրկված Գ.Ա.-ն 2021թ. հունիս ամսվա ընթացքում ծնողների հետ այցելել է իր ընտանիքի հետ մտերիմ հարաբերությունների մեջ գտնվող՝ Վայոց ձորի մարզի Գլաձոր համայնքում հաշվառված, բնակվող և ընտրելու իրավունք ունեցող Ա. Վ.-ի տուն, վերջինիս և նրա ընտանիքի անդամներին հայտնել «Պատիվ ունեմ» կուսակցությունների դաշինքով որպես պատգամավորի թեկնածու իր առաջադրվելու մասին և խնդրել կայանալիք ընտրություններում քվեարկել 6-րդ համարի քվեաթերթիկում նշված դաշինքի օգտին: Միաժամանակ, նպատակ ունենալով ընտրության արդյունքների ամփոփման, այն է՝ քվեաթերթիկների հաշվարկի ընթաքցքում ստուգել նշված անձանց կողմից «Պատիվ ունեմ» դաշինքի օգտին քվեարկելու հանգամանքը՝ առաջարկել է ընտրված քվեաթերթիկի վերին աջ անկյունային հատվածը ծալելու, այնուհետև ուղղելու միջոցով, թողնել այդ փաստը հաստատող՝ ծալվածքի տեսքով հատուկ նշան, ինչի մասին հետագայում կրկին հայտնել է հեռախոսազրույցի ընթացքում:

Այնուհետև՝ 2021թ. հունիսի 17-18-ն ընկած ժամանակահատվածում՝ ժամը 18-19-ի սահմաններում, Գ. Ա.-ն միայնակ գնացել է Ա. Վ.-ի տան բակ և «Պատիվ ունեմ» կուսակցությունների դաշինքի օգտին կողմ քվեարկելու համար վերջինիս առձեռն տվել 20.000 ՀՀ դրամ կաշառք:

Ձեռք բերված բավարար ապացույցների հիման վրա որոշում է կայացվել Վայոց Ձորի մարզի Գլաձոր համայնքի Վերնաշեն բնակավայրի բնակիչ, «Պատիվ ունեմ» դաշինքի պատգամավորության թեկնածու Գ Ա.-ին ՀՀ քրեական օրենսգրքի 154.2-րդ հոդվածի 2-րդ մասով որպես մեղադրյալ ներգրավելու մասին:

Վարույթ իրականացնող մարմնի որոշմամբ Գ. Ա.-ի նկատմամբ որպես խափանման միջոց է ընտվել ստորագրություն չհեռանալու մասին:

Պատշաճ դատախազական հսկողության պայմաններում ձեռնարկվում են միջոցներ գործի բազմակողմանի, լրիվ և օբյեկտիվ քննությունն ապահովելու, դեպքին առնչվող այլ անձանց գործողություններին իրավական գնահատական տալու ուղղությամբ։

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
