Պարզվել են Ջրաձոր համայնքի նախկին ղեկավարի կողմից առանձնապես խոշոր չափերի յուրացում կատարելու դեպքի հանգամանքները. ՔԿ

ՀՀ քննչական կոմիտեի Շիրակի մարզային քննչական վարչությունում իրականացված քննչական և դատավարական այլ գործողությունների արդյունքում պարզվել են Ջրաձոր համայնքի նախկին ղեկավարի կողմից առանձնապես խոշոր չափերի յուրացում կատարելու դեպքի հանգամանքները:

Քննությամբ ձեռք բերված փաստական տվյալների համաձայն՝ Շիրակի մարզի Ջրաձոր համայնքի նախկին ղեկավարը, համայնքի բյուջեից դրամական միջոցներ հափշտակելու դիտավորությամբ, օգտագործելով պաշտոնեական դիրքը, 2010-2015թթ. նշված համայնքի ավագանու քննարկմանն է ներկայացրել համայնքի բյուջեից մի շարք բնակիչների միանվագ դրամական օգնություն տրամադրելու հարցերը: Նշված հարցերին վերաբերող արձանագրություններում ավագանու որոշ անդամների փոխարեն ստորագրելու և այդ կերպ պաշտոնեական կեղծիք կատարելու պայմաններում, համայնքի բյուջեից, որպես միանվագ դրամական օգնություն, համայնքի բնակիչների անվամբ ելքագրել է ընդհանուր 335.000 ՀՀ դրամ գումար, որը յուրացման եղանակով հափշտակել է:

Բացի այդ, համայնքի նախկին ղեկավարը, օգտվելով այն հանգամանքից, որ 2011թ. հունիսի որոշմամբ համայնքի ավագանին համաձայնություն է տվել դեռևս խորհրդային տարիներին Կապսի ջրամբարի կառուցման նպատակով Շիրակի մարզի Ջրաձոր գյուղի վերաբնակեցման համար կառուցված 12 կիսակառույց շինությունները օտարելու և դրանց մեկնարկային գները հաստատելու վերաբերյալ իր կողմից ներկայացրած առաջարկությանը, 2011-2016թթ. ընկած ժամանակահատվածում ապամոնտաժել և մասնավոր անձանց է օտարել նշված շինությունների՝ 2.970.000 ՀՀ դրամ արժողությամբ կոնստրուկցիաները, սակայն վաճառքի արդյունքում գոյացած գումարները չի մուտքագրել համայնքի բյուջե և այդ կերպ վատնելու եղանակով հափշտակել է համայնքի՝ 2.970.000 ՀՀ դրամ արժողությամբ գույքը:

Արդյունքում, Ջրաձոր համայնքի նախկին ղեկավարը, պաշտոնավարման ընթացքում, պաշտոնեական դիրքն օգտագործելով, յուրացնելու և վատնելու եղանակով հափշտակել է իրեն վստահված՝ առանձնապես խոշոր չափերի` ընդհանուր 3.305.000 ՀՀ դրամ գումարի չափով գույքը և դրամական միջոցները:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ վերջինիս մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի 1-ին կետով: Նրա նկատմամբ որպես խափանման միջոց ընտրվել է ստորագրություն՝ չհեռանալու մասին:

Նախաքննությունն ավարտվել է, և քրեական գործը, մեղադրական եզրակացությունը հաստատելու և դատարան ուղարկելու միջնորդությամբ, ուղարկվել դատավարական հսկողություն իրականացնող դատախազին:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
