Ինչ կարող են անել գործատուները հոկտեմբերի 1-ից. իրավաբան

Իրավաբան Ռոբերտ Հայրապետյանն իր ֆեյսբուքյան էջում գրում է.
Ինչ կարող են անել գործատուները հոկտեմբերի 1-ից, երբ  ՀՀ առողջապահության նախարարի 20․08.2021թ.-ի N 65-Ն հրամանով իրենց վրա դրվել է հակաիրավական պարտավորություն, իսկ իրենք բարեխիղճ են և չեն ուզում խախտել ՀՀ ԱՕ-ը։

ՀՀ ԱՕ 3-րդ հոդվածի 2-րդ մասի համաձայն՝ Աշխատանքային իրավունքները կարող են սահմանափակվել ՄԻԱՅՆ ՕՐԵՆՔՈՎ, որն այս դեպքում առկա ՉԷ։

ՀՀ ԱՕ 33-րդ հոդվածով սահմանվում է, որ գործատուների կողմից ԱՇԽԱՏԱՆՔԱՅԻՆ ՕՐԵՆՍԴՐՈՒԹՅԱՆ, ԱՇԽԱՏԱՆՔԱՅԻՆ ԻՐԱՎՈՒՆՔԻ ՆՈՐՄԵՐ ՊԱՐՈՒՆԿՈՂ այլ նորմատիվ իրավական ակտերի, ․․․ պահանջների կատարման նկատմամբ պետական վերահսկողությունն  իրականացնում է ոլորտի լիազորված տեսչական մարմինը՝ ՕՐԵՆՔՈՎ նախատեսված դեպքերում կիրառելով պատասխանատվության միջոցներ:

Համաձայն Կառավարության 30.04.2020 թվականի N 718-Ն որոշման՝ տեսչական մարմնի կողմից համապատասխան ստուգումը պետք է իրականացվի ստուգաթերթով, որի վերջում ստորագրում է տեսչական մարմնի ծառայողը և տնտեսվարողը (գործատուն)։ Ստուգաթերթիկի լրացումից հետո մի ստորագրեք այն, վերջում նշում կատարելով, որ համաձայն չեք արձանագրված խախտման հետ, դրա ՀԱԿԱԻՐԱՎԱԿԱՆ լինելու հիմքով։ Հորդորեք որպեսզի տուգանքի վերաբերյալ ակտը ուղարկեն փոստային ծառայության միջոցով, այնուհետև այն բողոքարկեք վերադասության կարգով, իսկ արդյունքի չհասնելու դեպքում դատական կարգով։

Վերոնշյալ հրամանով խախտվում են ՀՀ սահմանադրության սահմանված համաչափության սկզբունքը (78-րդ հոդված), ինչպես նաև՝ Սահմանադրության 57-րդ հոդվածը (Աշխատանքի ընտրության ազատությունը և աշխատանքային իրավունքները) և ՀՀ աշխատանքային օրենսգրքի մի շարք էական դրույթներ։

Պետությանը թույլատրվում է իրականացնել մարդու իրավունքների և ազատությունների սահմանափակումներ այնքանով, որքանով դրանք պիտանի են և անհրաժեշտ են սահմանադրական այլ իրավունքների իրացման նպատակով։

Առողջապահության «իրավաբան» նախարարը, ով այսօր խոսում էր ֆանտաստիկ հիմարություններով մանիպուլացնելուց, բոլոր հարցազրույցներում վկայակոչում է «Բնակչության բժշկական օգնության և սպասարկման մասին» օրենքը, այնինչ իր ստորագրած հրամանը հակասում է այդ օրենքի առնվազն 25-րդ հոդվածին, որի համաձայն՝ յուրաքանչյուր ոք իրավունք ունի գրավոր հրաժարվելու բժշկական միջամտությունից կամ պահանջելու ընդհատել այն:

Հավատացեք, ապօրինի աշխատանքից ազատելու դեպքում առնվազն մեկ տարի հետո ստիպված կլինեք վճարել ամբողջ տարվա հարկադիր պարապուրդի գումար ՄԻԱՆՎԱԳ, գումարած դատական ծախսեր»։
