ՄԻԵԴ-ն Ադրբեջանին պարտավորեցրել է գերեվարումից ազատ արձակված Արթուր Բադալյանին վճարել 30 հազար եվրո

Մարդու իրավունքների եվրոպական դատարանը հրապարակել է հերթական վճիռն ընդդեմ Ադրբեջանի՝ արձանագրելով, որ Ադրբեջանը խոշտանգել և ապօրինի ազատությունից զրկել է ՀՀ քաղաքացի Արթուր Բադալյանին, ով մոլորվել և հայտնվել էր Ադրբեջանի տարածքում: «Արմենպրես»-ի փոխանցմամբ այս մասին տեղեկացնում է ՄԻԵԴ պաշտոնական կայքը:

Եվրոպական դատարանը Ադրբեջանին պարտավորեցրել է Արթուր Բադալյանին վճարել 30.000 եվրո՝ որպես ոչ նյութական վնասի հատուցում:

Նշվում է, որ 2009 թվականի մայիսի 9-ին դիմումատուն անհետացել  և գերեվարվել է ադրբեջանական ուժերի կողմից: Նրա գտնվելու վայրը անհայտ է եղել ընտանիքի և Հայաստանի իշխանությունների համար մինչև 2010 թվականի նոյեմբերի 5-ը, երբ Կարմիր խաչի միջազգային կոմիտեի կողմից  գրանցվել է որպես Ադրբեջանում պահվող հայ գերի: 2011 թվականին մարտի 17-ին գերիների փոխանակման շրջանակներում նա ազատ է արձակվել՝ ԿԽՄԿ-ի միջնորդությամբ:

Դիմումատուն՝ Բադալյանը, ՄԻԵԴ-ին ներկայացրել է, որ ադրբեջանական ուժերի կողմից գերեվարվելուց հետո 22 ամիս գերության մեջ է եղել տարբեր ռազմական հաստատություններում: Նա պնդել է, որ իրեն բավարար քանակությամբ սնունդ չեն տվել և հաճախ թույլ չեն տվել զուգարան գնալ: Ավելին, նա ենթարկվել է դաժան խոշտանգումների և հոգեկան տառապանքի: Հաճախ են հարվածել նրա ոտքերին, որպեսզի չկարողանա զգալ կամ շարժել դրանք, հաճախակի էլեկտրական լարեր են կապել նրա մատերին և հոսանքահարել: Բադալյանի խցի դռանը հարվածել են մետաղական առարկաներով, ինչի արդյունքում նա այժմ տառապում է լսողության խանգարմամբ:

Այսպիսով Արթուր Բադալյանը ընդդեմ Ադրբեջանի Հանրապետության դիմել է ՄԻԵԴ՝ Մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության մասին կոնվենցիայի 34-րդ հոդվածի համաձայն:

ՄԻԵԴ-ն էլ միաձայն ընդունել է հայցադիմումը: ՄԻԵԴ-ն արձանագրել է, որ տեղի է ունեցել Կոնվենցիայի 3-րդ հոդվածի (Խոշտանգումների արգելում -Ոչ ոք չպետք է ենթարկվի խոշտանգումների կամ անմարդկային կամ նվաստացնող վերաբերմունքի կամ պատժի) խախտում: Դատարանը միաձայն պնդել է, որ տեղի է ունեցել Կոնվենցիայի 5-րդ հոդվածի (Ազատության և անձնական անձեռնմխելիության իրավունք- Յուրաքանչյուր ոք ունի ազատության և անձնական անձեռնմխելիության իրավունք: Ոչ ոքի չի կարելի ազատությունից զրկել այլ կերպ, քան հետևյալ դեպքերում և օրենքով սահմանված կարգով)  խախտում:
