Կես­գի­շե­րից հե­տո առևտ­րի, զվար­ճան­քի, խա­ղատ­նե­րի և սա­ու­նա­նե­րի աշ­խա­տան­քը կար­գել­վի

«Փաստ» օրաթերթը գրում է

 

Էկոնոմիկայի նախարարությունն առաջարկում է փոփոխություններ կատարել մի շարք օրենքներում: Արդյունքում՝ համայնքի վարչական տարածքում առևտրի, հանրային սննդի, զվարճանքի, շահումով խաղերի և վիճակախաղերի կազմակերպման օբյեկտներին, խաղատներին և բաղնիքներին (սաունաներին) ժամը 24:00-ից հետո աշխատելու թույլտվությունը վերացվելու է: Նախագծի հիմնավորման մեջ ասվում է, որ «Տեղական ինքնակառավարման մասին» օրենքի համաձայն, համայնքի ղեկավարը տալիս է համայնքի տարածքում առևտրի, հանրային սննդի, զվարճանքի, շահումով խաղերի և վիճակախաղերի կազմակերպման օբյեկտներին, բաղնիքներին (սաունաներին), խաղատներին ժամը 24:00-ից հետո աշխատելու թույլտվություն։

Նույն դրույթը սահմանվում է նաև «Երևան քաղաքում տեղական ինքնակառավարման մասին» օրենքով։ Միաժամանակ, «Տեղական տուրքերի և վճարների մասին» օրենքը սահմանում է վերոնշյալ թույլտվությունների դրույքաչափերը, համաձայն որի՝ համայնքի վարչական տարածքում առևտրի, հանրային սննդի, զվարճանքի, շահումով խաղերի և վիճակախաղերի կազմակերպման օբյեկտներին, խաղատներին և սաունաներին կեսգիշերից հետո աշխատելու թույլտվության համար օրացուցային տարվա դեպքում վճարվում է՝ առևտրի օբյեկտների համար` հինգ հազարից մինչև հիսուն հազար դրամ, հանրային սննդի և զվարճանքի օբյեկտների համար` քսանհինգ հազարից մինչև հարյուր հազար դրամ, սաունաների համար` երկու հարյուր հազարից մինչև հինգ հարյուր հազար դրամ, խաղատների համար` հինգ հարյուր հազարից մինչև մեկ միլիոն դրամ, շահումով խաղերի համար` երկու հարյուր հիսուն հազարից մինչև հինգ հարյուր հազար դրամ, վիճակախաղերի համար` հարյուր հազարից մինչև հարյուր հիսուն հազար դրամ: Միաժամանակ Աշխատանքային օրենսգրքի 139-րդ հոդվածը սահմանում է ամենօրյա աշխատաժամանակի տևողությունը, որը չի կարող անցնել ութ աշխատանքային ժամից, բացառությամբ նույն օրենսգրքով, օրենքով, իրավական այլ ակտերով և կոլեկտիվ պայմանագրով նախատեսված դեպքերի:

Նշվում է, որ տեղական տուրքը, տեղական ինքնակառավարման մարմինների սեփական լիազորությունների իրականացմամբ պայմանավորված, օրենքով սահմանված գործողությունների համար համայնքի բյուջե վճարվող պարտադիր գանձույթ է: Այս դեպքում նախարարությունը հարց է տալիս՝ որո՞նք են տեղական ինքնակառավարման մարմինների սեփական լիազորությունները կեսգիշերից հետո աշխատելու թույլտվության տրամադրման գործընթացում։ Հաջորդիվ՝ ինչ վերաբերում է գիշերային ժամերին լռության պահպանությանը:

«Վարչական իրավախախտումների մասին» օրենսգրքի 180-րդ հոդվածը սահմանում է վարչական պատասխանատվություն՝ առևտրի և ծառայությունների, այդ թվում՝ հանրային սննդի օբյեկտների, ինչպես նաև սահմանափակման ենթակա ծառայության օբյեկտների բնագավառում ծառայություններ մատուցող կամ գործունեություն իրականացնող անձանց կողմից, ըստ տվյալ առևտրի և ծառայությունների օբյեկտի գտնվելու վայրի, համայնքի ավագանու կողմից սահմանված ժամերին (22:00-ից մինչև 7:00-ն, 23:00-ից մինչև 7:00-ն և 24:00-ից մինչև 7:00-ն) լռությունը կամ գիշերային անդորրը չապահովելու համար։
