Նարեկ Սարգսյանը կալանավորվեց

ՀՀ վճռաբեկ դատարանը ապրիլի 12-ի որոշմամբ բավարարել է ՀՀ գլխավոր դատախազության բողոքը, բեկանել ՀՀ վերաքննիչ դատարանի՝ 2020թ․ նոյեմբերի 12-ի որոշումը և օրինական ուժ տվել ամբաստանյալ Նարեկ Սարգսյանի նկատմամբ որպես խափանման միջոց կալանավորումն անփոփոխ թողնելու մասին Ընդհանուր իրավասության դատարանի որոշմանը։

Հաշվի առնելով նշված գործի հանդեպ հանրային հետաքրքրությունը՝ հիշեցնենք, որ ՀՀ ԱԱԾ քննչական դեպարտամենտում քննվող քրեական գործով 2018թ․ հունիսից ՀՀ իրավասու մարմինների կողմից հետախուզման մեջ գտնվող Նարեկ Սարգսյանը 2019թ․ դեկտեմբերի 21-ին արտահանձվել էր Հայաստան, և նրան վերջնական մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի 1-ին մասով, ՀՀ քրեական օրենսգրքի 268-րդ հոդվածի 3-րդ մասով, 38-131-րդ հոդվածի 2-րդ մասի 1-ին, 2-րդ, 3-րդ և 7-րդ կետերով։

Նարեկ Սարգսյանի նկատմամբ որպես խափանման միջոց է կիրառվել կալանավորումը։

2020թ․ հեկտեմբերի 9-ին նրա վերաբերյալ գործը մեղադրական եզրակացությամբ ուղարկվել էր Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարան՝ ըստ էության քննելու համար, և դատարանի հոկտեմբերի 19-ի որոշմամբ ընտրված խափանման միջոցը թողնվել էր անփոփոխ։

Այս որոշման դեմ վերաքննիչ բողոք էին ներկայացրել Նարեկ Սարգսյանի պաշտպանները, որը ՀՀ վերաքննիչ դատարանի 2020թ․ նոյեմբերի 12-ի որոշմամբ բավարարվել էր մասնակիորեն՝ Առաջին ատյանի դատարանի որոշումը բեկանվել էր, Ն․Սարգսյանի նկատմամբ կիրառված կալանավորումը փոխվել էր, և նրա նկատմամբ որպես խափանման միջոց էր կիրառվել գրավը՝ 25մլն դրամի չափով։
