Ապրիլի 7-ին տեղի ունեցած կանանց բողոքի ակցիայի մասին

Լուսավոր Հայաստան խմբակցության պատգամավոր Անի Սամսոնյանը ֆեյսբուքյան իր էջում գրում է.
 
Սույն թվականի ապրիլի 7-ին «ՎԵՏՕ» հասարակական-քաղաքական շարժման մասնակիցների կողմից Կառավառության շենքի դիմաց կազմակերպված բողոքի ակցիայի վերաբերյալ համացանցում հրապարակվել են մի շարք տեսանյութեր, որտեղ առերևույթ արձանագրում ենք ոստիկանների կողմից անհամաչափ ուժի կիրառման դեպքեր։
 
Դրանք իրականացվել են ոչ միայն շարժման կին մասնակիցների նկատմամբ, այլև այն լրագրողների, որոնք այդ ընթացքում կատարել են իրենց աշխատանքային մասնագիտական պարտականությունները։
Այսպես, «Yerevan.Today» լրատվական վերլուծական կայքում տեղադրված տեսանյությում երևում է, թե ինչպես է ոստիկանի կողմից կիրառվում անհամաչափ ուժ լրագրողի նկատմամբ:
 
«Tert.am» լրատվական վերլուծական կայքում տեղադրված տեսանյությում արձանագրված է, որ ոստիկանների կողմից բռնի ուժի գործադրմամբ բերման է ենթարկվում քաղաքական գործիչ Վազգեն Մանուկյանի կինը՝ Վարդուհի Իշխանյանը: Նույն կայքի մեկ այլ տեսանյութում երևում է, թե ինչպես են կրկին բռնի և անհամաչափ ուժ կիրառում ակցիայի կազմակերպիչներ՝ «ՎԵՏՕ» հասարակական-քաղաքական շարժման կին մասնակիցների նկատմամբ:
«News.am» լրատվական վերլուծական կայքում տեղադրված տեսանյությում արձանագրված է, թե ինչպես են ոստիկանների կողմից կրկին ոչ անհամաչափ ուժի գործադրմամբ բերման ենթարկվում ակցիայի մասնակիցները։
«Ոստիկանության մասին» ՀՀ օրենքի 29-րդ հոդվածի վերլուծությունից հետևում է, որ ոստիկանության ծառայողը որպես բացառիկ միջոց կարող է գործադրել ֆիզիկական ուժ, հատուկ միջոցներ և հրազեն, այնքանով, որքանով դա անհրաժեշտ է իր պարտականությունները կատարելու համար, եթե այլ միջոցներով այդ պարտականությունների կատարումը հնարավոր չէ ապահովել:
Փաստում ենք այն, որ ոստիկանությանը վերապահվում է ֆիզիկական ուժ կամ հատուկ միջոց կիրառել, սակայն այն պետք է լինի հետապնդվող նպատակին և կոնկրետ տվյալ իրավիճակին համաչափ:

Ելնելով վերոգրյալից դիմել եմ ՀՀ ոստիկանապետին քննության առարկա դարձնելու հետևալը․
 
1. Արդյոք 07.04.2021 թվականին իրականացված ակցիայի ընթացքում ոստիկանների կողմից կատարված գործողությունները եղել են համաչափ տվյալ իրավիճակին և վերջիններս թույլ չեն տվել «Ոստիկանության մասին» ՀՀ օրենքի 29-րդ հոդվածովվերապահված լիազորությունների չարաշահում:
 
2. Այդյոք վերջիններիս կողմից կատարված գործողություններն իրենց մեջ չեն պարունակում ՀՀ քրեական օրենսգրքի 164-րդ հոդվածի 2-րդ մասով նախատեսված հանցակազմի հատկանիշներ, այն է. «Լրագրողի մասնագիտական օրինական գործունեությանը խոչընդոտելը կամ նրան տեղեկություններ տարածելուն կամ տարածելուց հրաժարվելուն հարկադրելը, որոնք կատարել է պաշտոնատար անձն իր պաշտոնեական դիրքն օգտագործելով»:
 
3. Այդյոք վերջիններիս կողմից կատարված գործողություններն իրենց մեջ չեն պարունակում ՀՀ քրեական օրենսգրքի 163-րդ հոդվածի 1-ին մասով նախատեսված հանցակազմի հատկանիշներ, այն է՝ «Օրինական հավաքներ անցկացնելուն խոչնդոտելը»:
 
4. Արդյոք բերման ենթարկված անձանց ներկայացվել են գործողության հիմքերը և այդ կարգավիճակում նրանց իրավունքները։
