Նոր Նորքում ծեծի հետեւանքով մահացած 80-ամյա տարեց քաղաքացու գործով կա մեղադրյալ. Ռուբեն Մելիքյան

Նոր Նորքում օրեր առաջ 80-ամյա տարեց քաղաքացուն ծեծելու եւ նրա մահվան դեպքի գործով կա մեղադրյալ։ Նրա նկատմամբ գրավը որպես  խափանման միջոց է կիրառվել։ Այս մասին Ֆեյսբուքի իր էջում գրել է  իրավապաշտպան Ռուբեն Մելիքյանը։

Նա, մասնավորապես, նշել է.

«Հենց նոր տեղեկացա, որ Նոր Նորքում 80-ամյա Ավետիք պապիկի բռնի մահվան կապակցությամբ արդեն կա որպես մեղադրյալ ներգրավված անձ։ Մեղադրանքը «առողջությանը դիտավորությամբ ծանր վնաս պատճառելն է, որն անզգուշությամբ առաջացրել է տուժողի մահ» (ՀՀ Քրօր. 112 հոդվածի 2-րդ մասի 14-րդ կետ՝ 5-10 տարի ազատազրկման հեռանկարով): Որպես խափանման միջոց է ընտրված գրավը։

Տուժողի ընտանիքին բացատրել եմ, որ խափանման միջոց կալանքը ծայրահեղ միջոց է, եւ այն կարող է կիրառվել միայն այն դեպքում, երբ մյուս խափանման միջոցները ունակ չեն ապահովել մեղադրյալի պատշաճ վարքագիծը։ Այդ առումով՝ մեղադրյալի նկատմամբ կիրառված գրավը թերեւս պետք է համարել իրավաչափ՝ քանի դեռ մեղադրյալը նորմալ վարքագիծ է դրսեւորում։

Այսօր ավելի վաղ լայվով նշել էի. ունեմ հիմքեր պնդելու, որ նախաքննությունը լինելու է բազմակողմանի, լրիվ եւ օբյեկտիվ։ Այդ լավատեսությունս կարծեք թե հաստատվում է։

Շարունակելու եմ հետեւել վարույթին եւ հարկ եղած դեպքում իրազեկել հանրությանը»։

Հիշեցնենք՝ ապրիլի 4–ին, իրավապաշտպանը ֆեյսբուքյան գրառմամբ հայտնել էր, որ  անհայտ պատճառներով 80 տարեկան մարդուն օրը ցերեկով վերջին ձեւով ծեծել են, որի հետեւանքով ժամեր առաջ  քաղաքացին մահացել է։
