Օնիկ Գասպարյանն իրավունքի ուժով ազատված է պաշտոնից. փաստաբանը՝ նախագահի հայտարարության մասին

Հանրապետության նախագահ Արմեն Սարգսյանի՝ քիչ առաջ հրապարակած հայտարարությունից հետո Օնիկ Գասպարյանը համարվում է պաշտոնից ազատված: 

Փաստաբան Նորայր Նորիկյանը մեր զրույցում այսպես մեկնաբանեց նախագահի հայտարարությունը եւ դրանից բխող իրողությունը.

 

«Հայաստանի Հանրապետության Սահմանադրության 139-րդ հոդվածի 3-րդ կետի համաձայն՝ եթե Հանրապետության նախագահը չի կատարում սույն հոդվածի 2-րդ մասով սահմանված պահանջները, այն է՝ չի ստորագրում համապատասխան ակտը կամ դիմում Սահմանադրական դատարան, ապա ակտը ուժի մեջ է մտնում իրավունքի ուժով:

 
 

Հաշվի առնելով այն հանգամանքը, որ Հանրապետության նախագահը չի ստորագրել միջնորդող կողմի՝ ՀՀ վարչապետի կողմից երկրորդ անգամ ներկայացված միջնորդությունը եւ այդ հարցով չի դիմել Սահմանադրական դատարան՝ հետեւաբար իրավունքի ուժով զինված ուժերի գլխավոր շտաբի պետ, գեներալ-գնդապետ Օնիկ Գասպարյանին զինված ուժերի գլխավոր շտաբի պետի պաշտոնից ազատելու՝ վարչապետի կողմից ներկայացված միջնորդությունը իրավունքի ուժով մտել է ուժի մեջ:

Օնիկ Գասպարյանն այլեւս իրավասու չէ կատարել ԳՇ պետի պարտականությունները, քանի որ իրավունքի ուժով ազատված է պաշտոնից»:

Հարցին, թե իսկ ի՞նչ է նշանակում նախագահի հայտարարությունը, որ առանձին դիմումով դիմելու է ՍԴ՝ «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» 2017թ. նոյեմբերի 15-ի ՀՀ օրենքի՝ Սահմանադրությանը համապատասխանելու հարցը որոշելու խնդրանքով, Նորիկյանը պատասխանեց.

«Նախագահի հայտարարությունում չի ասվում, թե այդ օրենքի որ հոդվածն է վիճարկվելու, այնտեղ խոսվում է մտադրության մասին: Երբ որ նման հարց բարձրացնի, դիմումի բովանդակությանը կծանոթանանք, դիրքորոշում կարտահայտենք»:
